Given the hopelessness of the situation in March, switched jobs and was unable to file labor for a variety of reasons. Now everyday I see people come over and tell me how they plan to switch jobs once the 6 month mandated hibernation is over...I feel like breaking something. Lot of them have even stopped working, confident that a new job awaits :mad:
8 years of paying taxes in this country and not even a piece of plastic to show for it. :mad:
--That ought to suck every bit of sanity left! I know "should have..would have..." doesn't matter anymore but I am curious why you did not opt to do labor substitution in june-july period. You should have had a crack at it.
I know people on h1 with consulting companies did better than those who got stuck with one permanent job.Stale career , stale pay and so on...
Do your best and make most of h1b.

While we can seek IV's help in this for future.......
If majority of the people
- dont want to be involved with IV action items,
- can not overcome their obsession about receipt notice and FP notice and EAD/AP approval...., and anxiety attacks about visa bulletins
then there will be a time where there is no IV.

So, does that mean there's no need to invoke AC21 after you get you get EAD, if you want to change employer before 180 days of your filing?
if you change your employer within 180 days of 485 RD, the employer can revoke your 140 which will invalidate your 485.
After 180 days you can switch using your H-1 too. The EAD is not necessary.

As far as I know if the old I-140 is revoked or withdrawn before new I-140 approval one can not port PD.
My old I-140 is still active so it was safe while porting. I am not sure what happens if the old I-140 is revoked, sorry i don't have answer for this..

well..I have been waiting for my labor certifcation to get certfied for too long. just after Sep 11 I applied both for US GC and Canadian PR. My wife also applied for her GC. meanwhile her GC moved to regional when suddenly DOL thought it was time to regroup and there it went into BPC. In the meantime we got canadian PR some 2 years ago but we did not move thinking that we have jobs here.Then she got pregnant and lot of complications ( premature labor) and during those complications her company got acquired by another bigger firm who thought they don't need her..and result was job loss plus GC into the trash....meanwhile my labor certification even after 5 years was still sleeping in EB3 category(PD Oct, 2001) when i still have Masters( god knows why my lawyer put into that category)..Now my canadian PR was set to expire in march, 2007..so I thought i should decide fast..and i applied for jobs..and I got offer in vancouver with moving expenses paid from califronia..It has been the toughest decision because my employer is Indian here in california..and I have had good growth(10% average) but not the way I had wanted..I guess he also exploits..Indian exploiting another Indian..because they know I am not going anywhere..plus we work hard.. I asked him to match what was being offered in vancouver..and he started converting CAD into USD..well..it is not fair..So I have decided to heck with US and the Employer..and move on...at least I can come back..it is not an easy move because my son being premature child had lot of free facilities in california..hopefully he will get the same in Vancouver until he gets to 3 years ..and then it stops..

I wish things could work out for you in US. It is sad and there are thousands of people like you with badly affected personal lives due to the broken immigration system. A lot of my motivation to work for IV also comes from coming across people like you and thus feel strongly to do something to solve problems affecting each one of us in the IV community we have all built. I just check oxford dictionary to make sure whether I screwed somewhere but what I found is it was request to dollar500 from my side. It was not a advise. Rather you are advising me not to advise.. Is not it contradictory?

Can anyone please help me with the EFile of EAD. I am applying for my first renewal.
1. Question: Have u ever applied for EAD? if Yes, Date for application:
Which date should we fill in here. Should it be First EAD Received Date or Notice Date or approved Date?
2. While Efiling we have a field (With dropdowns) Current Immigration status(Visitor, Student etc..) which drop down value should we fill if we are on 485 Pending (AOS) as my H1B expired already?
3. If you pick C9 for Eligibility Status Question, we have a Text box for the question, please provide information concerning your eligibility status.. what should we fill in this box?
4. At the end of Efiling, does it provide us with any supporting documents that needs to be mailed? or Do you know which one to send? As per the Paper based document instrcutions we should send, 485 copy + EAD Copy. No photos as per the Efiling instructions and should send the EFiled receipt notice..

It purely depends on your personal circumstances and how much you are willing to stretch. Though the life in Canadian - US is pretty similar, in my experience we all are so attached to the US that moving to Canada may not work for all of us.
I had Canadian PR in Year 2000 , i temporariliy moved to explore my option with longterm plans , but unfortunately it did not work out , i even tried windsor-detroit option, it too stressful and i personally feel it ani't worth !!
My 2 cents!!!

I have RN from vermont for H1b extension 1/14/2008 - still pending.
Not that it is really part of the issue here, but Vermont is also processing my I485 - how is it they are almost 1 YEAR behind TX and NE processing times? Will this be resolved by load balancing at some point, or is this random?
