It is not clear what you mean when you say that. How can you get EAD without filing for 485 [which you can file only when your PD is current].

2004 July - labor cleared for my husband
2004 December applied for I140 and I485 --- I 410 approved EAD and AP issued
I was in the country on F1 and applied for I485 along with my husband in 2004
Graduated in 2005 and changed to H4 immediately although not required since the status is Adjuste status
So when my PD becomes current they will let me know if we get GC or not
My question was since i applied for I485 when i was on F1 will it be a problem. I asked my lawyer and he said no. But i dont know how far he is correct.

If someone is a customer of Teleblend, they should contact them and ask them to provide a matching world plan service. Or else you and your friends will switch to Vonage. You will be surprised how fast teleblend will come up with a better plan than Vonage. In this country customer is the king. Vonage is trying to tie you up with an yearly plan. Wait and get Teleblend or other company to give you a better deal and you will save more money. Vonage is banking on being the first and capturing the market for 1 year before others give a better deal. It had to do it because people were switching to Teleblend, Omma or MagicJack. Now it is time for customers to contact these company senior executives and ask them to give you a good plan if they want you to stick with the company.
For now Vonage is good plan for who call India frequently and costumer service is good (atleast when you are their costumer). This will at least create some competition among the VOIP companies and Indian calling card companies. When some body comes with a better plan or service or Vonage is not doing good than we can switch to other. Competition like this between companies only consumers (like us) gets benefit.

I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.
Pls. Stick around in IV and help others with your knowledge.
I have received two A#s since I submitted a second set of AOS (first set had a number of omissions and I did not want to miss the boat).
I think there is no reason to lose sleep over this issue (actually I was told so by a renowned lawyer with whom I just did a consultation), and there is not much we can do anyway. Except... if possible we should send a letter to USCIS telling them about these two sets of applications and then asking them to choose the one which is approvable (again, I was told so by the same lawyer).
BTW canadian_dream: heartiest conrgatulations on your green card approval, your posts on the multiple filings issue have been very helpful.

I am tired of short term projects and I started my FT job search in March first week, got 2 offers, both companies are fine with EAD. Only question HR asked me is, "your EAD expires in Sept,when are you starting the renewal process?" I told her that I can apply for renewal only within 90-120 days time frame. She was fine with my answer and also mentioned that she is aware of the fact there is some time line for EAD renewal.
I'll be starting my new FT job from Monday.
So bottom line is there are some HR people who are well aware of EAD and the strings attached to it. You are definitely going to meet them sooner or later, don't loose hope.
BTW why am I using AC21? - my PD is March 2006 (EB3 India), so I decided to use AC-21/EAD, as nobody knows how long this GC journey is? I am already in my 8th year of H1.

That's good news APB.
I guess it may either be the SR that I opened for my wife or the letter I wrote to Napolitano...my wife got a call from a CSR from DC and she told that her case is pending because of the Biometrics, she said she is issuing new biometrics...the speaker phone was on...and I interjected...how come I got approved w/o the Biometrics...she was clueless...I told her how many times can Biometrics notice be issued...my attorney called TSC on 10th of Sept and that time a notice was issued which we never received and then again two weeks later someone else issued another notice.....then someone else told that Biom is fine it just needs uploading and it has been two weeks since then the only thing that is happening is the Visas getting used up .....I said what's the point of FP/Biom if visas are no longer available which surely will be the case in 3 weeks....
In any case didn't expect a phone call from them so was surprised.

I got fired last April. I had my I-140 approved. Employer HR told me will not withdraw I-140 but cannot give me employer letter. How should I proceed with filing I-485? Please help.

I have seen some posts that suggest using paystubs but this is tricky for you since you won't have anything recent since last April. One gamble would be to file and hope you get an RFE after 6 months when you can get a letter from a new employer ie AC21. However USCIS is warning that they will reject applications if the 'initial evidence' is missing. Do you have a new LC? If so, you could file I-140 premium processing and keep your original PD. Is your former employer willing to re-employ you in the future (assuming your job loss was related to the employer's financial issues) ?? You likely will need a lawyer to work around the hurdles you are facing.

Finally we got our receipt numbers today from the Check Images. Our Application reached USCIS on 07/03 by USPS Mail. Don't know who signed it. Have been waiting for it patiently. All our receipt numbers start with SRC so from Texas. My I140 was approved form Texas and there was an LUD on the I140 on 07/28.
All the best for whom ever is waiting for the receipt numbers. You guys should get it pretty soon.

EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. We need to expose the fraudulent EB1 filing by Indian companies! Under the circumstances, I think that this issue is much more relevant now! As such, I would once again like to share the information which I obtained about 6 weeks back from the local Congressman's office.
I was pleasantly suprised to learn that many Indians have been quietly writing about the fraudulent EB1 filing by Indian IT companies to lawmakers! I was told that the local office had received about 50 or so signed (hard copy) letters and that they had subsequently spoken to the INS office about this. It is a good thing that some conscientous Indians are quietly working behind the scenes for the welfare of the community.
Subsequently, I also made a letter on the subject and hand delivered the same the very next day, to the Congressman's office. I then also posted my letter to the Senators of my state.
I once again plead with all fellow EB Indian friends to write letters (please do not Email) about the fraudulent EB1 filings by Indian IT companies (TCS, CTS, L&T-IT, Infosys, Vetri software, et al) to your local congressman / senators. Please also visit your lawmakers to follow up. Personally, I feel that this very very important. IV is there to help us, but all of us must also play a role to get results
It is the strategy that will win the war, not always brute force! We should adopt a multi-pronged attack strategy, realising that each ever visa no. we get is important!
Spending about an hour of your time to write, print, sign and post could save many atleast 2 years of wait time. Did your realize this?
Imagine the impact of 1000s of covers getting dumped in your law makers' offices!
Even lawmaker's offices feel that the impact of printed and signed hard copies is much higher than Emails!
If we are united and focused, we can all win!

I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.
