Restrictions on H1B is definitely not going to help retain jobs in America. More technnical jobs will be outsourced. My friend work for a TARP company and they are directed to move more technical jobs to offshore. The raid and other things what they are doing now will certainly prevent fraud.

It may not have any impact on EB3 this year...but once the EB2 is cleared it will have an impact on EB3; may be in a year or two.
Not sure i agree with that statement. The way the spillover trickle is reaching EB2 there is no way EB2 will become current for atleast 5 years so impact on EB3 within a year or two is a incorrect statement

it looks like many folks got their approval one day after filing an SR - coincidence or a trigger? Is filing the SR somehow triggering the IOs to look at your file ?
However, many people who filed SR on the first working day of the month 08/02 were not approved the next day. Also, the many others who bombarded the USCIS with multiple requests/queries had to wait much longer or are still waiting.
It is almost like the IOs didn't like to be bothered on the first working day of this month (when the begin working on a fresh set of files) and also didn't like to be pushed too much.
Or is this all just a super coincidence for hundreds of people?

This is awesome even before getting the flowers we have achieved what was intended.
I request members to refrain from making personal comments.
Everyone has got their opinion but if that is against our idea and thoughts we should tackle it fairly.
Anyways KUDOS to Everyone participated in this cause.
The message was reched to whoever it needs to ( Media) and USCIS make it easy by posting the same in www.uscis.gov website. This is a big victory for IV and the next step is to have a big rally to carry the message forward. Please vote to join rally in DC for the week end

For those in South ( Texas, Oklahoma, New Mexico, Louisiana) best way to go to India is new Emirates direct flight between Houston and Dubai and then onward to India.
I have had 3-4 friends fly this route since they started flying in November 2007 and they have nothing but praise for everything. These guys have excellent food and entertainment and no transit visa hassels plus duty free sopping in Dubai is good.
Pluse - they put you up in a hotel if your Dubai layover is more than 8 hrs (for economy class passengers) and you get a free transit visa to visit Dubai. During my last trip to Bangalore, I went via Dubai (NYC - Dubai direct flight) and on my way back we had 11 hrs layover. My wife and I got a chance to see the city. Next time we are going to India we are planning on staying for a few days and go for their desert camp trip.
I have heard pretty good things about the emirates in the past. I was considering it for my next trip.
But a friend of mine traveled Emirates recently (Dec 07). His flight (and few other flights) from Dubai to India got canceled. He had to wait in the airport for 24 hours and some people for 48 hours for the next flight. That was not bad, he had to wait in line for 10 hours (yes, I am not joking) to get his booking for the next day. They did not provide the accommodation to any one. He says they were not even sorry that this happened.
He says all the passengers slept in the corridors like how they do in busy bus stand platforms. It was unbelievable but true.

The whole idea of this campaign was to get media attention and publicize this issue as much as possible, which we all know that it did just that quite effectively despite all the apprehensions and reservations expressed.
This campaing was never thought of as a panacea for all our problems, whether it will lead to a fruitful or POSITIVE result that is still unknown. What is known is that this drive has provided some much needed traction and attraction to our cause, which is the important RESULT at this point in my opinion.
All I am trying to say is that we should give some thought and imagination before discounting or discarding an idea even if it appears to be far fetched at first. Any idea proposed which is out of the ordinary will be meted with reservations and oppositions, after all its nature's law that there is always resistance to change,:rolleyes: good or bad.
I don't want you to be eating your words :D , I know for sure that you want this problem resolved as much as anyone else on the forum.:D

I think the thread is perfectly valid and we should go for it. If someone has paid income taxes to US for 10 years, it is no mean thing. 10 years represent typcially about 25% of his/her earning life. After spending substantial percentage of one's life living in, and making contributions to, US, especially in his/her youth, the guy is more naturalised except that he does not have a citizenship card. Now how many of these guys will be able to slip back in to their own country to readjust their lives with american born and american grown kids.
I think it is not only reasonable but also humane for the government to consider the plight of such people and issue citizenship. The yardstick for qualification will have to be worked out, but Saralayar listed some of the valid parameters like
- 10 years working in US (legally)
- 40 points in social security
- no criminal record
If I may share my thoughts on yardstick, it would be like this
- 7 years of legal residence, contributions to SSN, and taxes should provide provisional GC
- 10 years of legal residence, contributions to SSN, and taxes should provide citizenship
- 7 years of legal residence post approved I-140 should provide citizenship
Most of us in this forum must have already contributed over 75K-100K to IRS over the years. I strongly believe that the govt owes more than an obligation to take care of the interests of this skilled group.

We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.
I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.
Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.
I think this bill will not be passed if it is against WTO trade regulations.
So you never know all these violation when you were in H1. What were you doing then. Why didnt you oppose then. If you know the violation did you call the USCIS and DOL and complain...No. Because you would end up in trouble. Now you got your GC and no matter if other guys are end up in trouble, in fact it would be helpful for you... Are you ready to review your status thorught all your H1, all your PREM processing to prove there is no violation...? Eveyone know how things are working. So if you got your GC just keep quite and move on. When you can not be helpful to others...why you are just creating pain.
If you are worrying about the wages..let them free the employees from employer. Thats the best way to clean up the system. If you are really pro-immigrant your thoughts should align in that direction. But most of us see you as Ron Diamond in the making. Its very unfortunate. According to the report of AILA, State Department had exhausted FY 2010 immigrant visa numbers as of 09/16/2010 for the following preference categories and the State Department would not allocate any immigrant visa numbers to the visa posts and the USCIS for these categories during the period. The affected preference categories include all family-based preference categories, employment-based preference categories of EB-2, EB-3, EB-EW, EB-4 and eertain Religious Worker categories. The State Department will keep taking immigrant visa number requests from the visa posts and the USCIS even during the gap period but the State Department will not be able to allocate the numbers until October 1, 2010 or thereafter when the new FY 2011 immigrant visa numbers will become available for these preference categories. There may be some cases for which the USCIS has requested and the State Department has already allocated the visa numbers before 09/16/2010 and these I-485 cases will receive approvals even during the cap-gap period. However, in general, I-485 applicants will witness either a slow-down or vacuum in receiving I-485 approval notices and news until October 1 or thereafter because of the gap. The gap will last only for about two weeks and I-485 applicants should keep patience during the period.

I think we should concentrate on things which are beneficial for everyone - not only EB1-2 or 3 . We should get USCIS to improve efficiency, use all visas, get applications processed according to their PD and not randomly and above all do away with the country limits which is the biggest cause of this retrogression.
When there are so many big issues pending I wonder why not concentrate on them instead.
There are so many people from all EB categories whose I-140 has been pending for more than a year. Shouldn't that be a priority also because without an approved I-140 their GC will also not be approved even if they have a PD from 2001-2002.
