If you entered on AP and your I485 is pending, you cannot fell out-of-status as you are being considered in "Adjustment of status" status. This is somehow a special kind of a status. The only problem one may have is if the I-485 is denied for any reason. At that point you fell out of status. That's the reason many choose to enter on h1 instead AP. Then, even if I485 is denied, a person who entered on H1 is still in H1 legal status. Hence, it is generally advisable to enter and maintain an non-immigrant status while i485 is pending.

I and my wife both have approved I-140. My PD is Dec 8, 2003 and my wife has Dec 24, 2003. I am applying as beneficiary through my wife's application. Is it possible to use my PD instead? Both are EB3.

Damn this sucking life man, no social life, no career life, no nothing life. Even animals must be living a better and meaningful life. It sucks big time, did it ever happen in history that uscis revised a visa bulletin on the day it is supposed to go into effect ....

my lawyer's office just called me saying they would want to file ASAP, for which they want my signatures tomorrow. I met her an hour ago, when she was saying things like "hopefully by next week".
So whether or not this is a rumour, it sure has clicked the panic button for lawyers too!
If this is true, it is unimaginably bad. (Personally I still think it won't happen till end of July.)

I sent 20 posters today by smail mail and now I have already called 12 member's offices. Please call them and make them hear only about 5882 till this is cleared. I am telling them " I am so n so, calling from x, and this is to request Mr. to support the Visa recapture bill for LEGAL IMMIGRANTS, HR 5882. Please call. More voices can only be heard loud. Lets join hands.. Together we can make it..

We can raise the issue is that the govt does not want to address our plight as
1. We are not entitled to any benefits till we get our GC such as Social security, benefits etc though we pay taxes which inturn are used by US citizens
2. We contribute to the economy by buying goods etc so there is a dual intent to keep the foreigners here but not to give them GC/citizen ship asap

I agree totally, this is a catch 22 situation for employment based immigration and agree that this will only divide more of us who are in different situations and are all waiting in line. I am not on L1 but to have introduce a bill that is protective in nature will only hurt immigration even more in the long run. Some of us may think this will eliminate lot more people from the line so that we who are working as permanent employees can get our green cards faster. Consulting companies are not just small companies, KPMG, Microsoft, Delliote, Oracle all of they offer some form of consulting to their clients. How will this law be implemented, what will happen to us who plan to change jobs after getting green cards and plan to consult if these companies don't exist. Every time a bill gets introduced, there is an intent but there is also the question of how it gets applied.
I think this will only hurt us as written from reading everything, this has all the language on discrimination against otherwise eligible workers, remember someday all of us who are permanent employees may be working as consultants, if you think today this is applied only to H1/L1, what will stop them from applying against EAD holders too? After all how many of us are on EAD, 300K? do you think that is a big enough group.
Stay together, stand together and read between the lines. Always fight for open legal immigration for employment, if you feel somebody is not qualified, so be it, its for the employer to make that call if he or she is qualified or not. If the client or the employer does not feel they are getting their money;s worth, that is a business decision for them to make, how do we who are standing in line for our green cards make a call on who is or not qualified?

I talked to my immigration about this today. My wife is on h4 and her h1-b is not selected in this year lottery process. I wanted her to go a school which issues CPT in less than one year so that she can start work. But my lawyer strongly recommended not to change her status from H4 to F1. My PD is 24 March 2005 EB2. Lawyer told me that it might cause a problem for my wife to get the GC on her I-485 application. Lawyer said some of her clients got through without a problem and some of her clients have problem regarding status change from h4 to f1. Fianlly i decided not to take that risk. I'm still waiting to file I-485.
My lawyer also strongly advised me against converting her H4 to F1. However since there was no visibility so I asked him what to do to get my wife working status. It was then he advised me that if she wants to start working badly then go ahead and apply for F1 but don't travel out of country while on F1.

If it is not included then we need to take in to account that for every 485 application we will bare minimum have 1 spoude 485 application that requires VISA Number.

1. EB1 is now the biggest uncertainty
2. EB2 ROW

We wasted lot of time, money and effort with this 485 filing for the last 15 days. I am terribly disappointed with the outcome now.

I agree with focusing on the Logfren bills, but the flower campaign might not work. Last year it was a combination of pressure on the lawmakers, USCIS and DOS by IV, AILA and a other groups. the flower campaign highlighted the issue to the public and gave us wide exposure...last years fiasco did not require a law change. In our case the clear cut issue is to make recapture happen. The only why for it to happen is by pressuring the lawmakers to take a yes or no decision.
I think we should all request our employers to call the lawmakers, individual calls will help but we need to take it to the next level as the window is very short.
Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..
What does EB-3 thinks..we can send flowers to these guys and also to Charles Oppenhiemer...
Flowers anybody??;)

Senate introduced the "Protecting America�s Competitive Edge (PACE)" Act on Jan 26th. One of the sections states that folks with advanced degree are exempt from the numerical limitations on employment-based immigrants.
Is this true ? If yes, should the advance degree holders pursue this bill.

Travelling via London Gatwick and Dubai to India and back. No airport change required during transit. Using AP, visa expired. I have a valid Canada PR card.
According to UK embassy US GC and Canada PR card holders do not need transit for direct airside transit. Does anyone have any experience in this situation? Please post.
