Hi , thank you so much for answering my questions , i am really happy to come across with some one who have filed on their own . if u don't mind can u tell me what did u filed with the 485 packet , i do have the i485 list , is there anything special you would like me to guide into ... did u filed the EAD together the 485 or to Chicago address .. how abt AP ? did u get the receipt .. please guide me

Filed for EAD for my husband along with the I 485's and have had all receipts, also had fingerprints done already, exactly one month after the receipt date. Sent both entire packets of forms with checks to Nebraska. We did not file advanced parole since I still have a valid H1B and plan to stay in my current job until I get my card. Husband will work on EAD and will not travel until gets his card, no family left in England.

I called the USCIS office today. I am on H1b and my spouse is here on H4. I am filling 485 under EB2..
They said clearly that we need to submit I 864 form for support, not I 134 which few people have mentioned in this forum so far..
So I am going with I 864..

What stops USCIS is the per country cap. They can only issue so many visas to EB-3 I.

Today is my day. After 13 years into this country, finally I am green. I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. BUT this could be just incidental. Thanks IV. I have updated the profile. I only received the email, no text message.

What will happen is - they will pluck the notes from the baskets and then forward the flower baskets as a batch to the vets. I am sure someone at USCIS is going to read the notes.

If they change the "contract" you agreed to initially - then you have every right to get out of the contract without any termination fees. It may take some arguing with the CS - but I know some people who have done this successfully with telephone companies like Verizone/Sprint etc when they changed some inconsequencial T&C.

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?

Not excatly. eb3_2004 has posted the link of INA. You will find more interesting things if you read through it.
Non-descrimination rule is clearly spelled out in Section 202 (a). I assume this rule should be generally applied to all applicants, no matter which categories they are falling, unless other rules specifically provided in paragraph (2) and in sections 101(a)(27) , 201(b)(2)(A)(i) , and 203.
INA does not say to spillover unused visas first to EB2 then EB3. I assume USCIS and Department of State should treat each EB applicants equally (based on their priority dates, not based on EB categories) in according to INA act.
It is likely the misinterpretation violates the law. We need some one which more professional knowledge to read through it. Can some core member help?

If I am not wrong, buffering wud be to take in new 485 applications, process them and keep them ready.
In that context, most of the applications till 07/07 have been preadjudicated, new buffer wud require dates to be pushed to 07/07 or later.
If they add EB2ROW Fall across numbers(6-8k) from first 6 months it will be 20K towards EB2IC backlog. USCIS may need buffer since all pending cases are not pre-adjudicated and some cases will be denied.
20k can clear all back log until 01-JAN if they need buffer they can move to 01-MAR-2007( 2 months or 5k) or 01-MAY -2007 (4 months or 10k), worst case can go to 01-AUG-2007(7 months or 15k)! my guesstimate.;)

I am in a unique situation. I had concurrently filed I-140 and 485(EAD and AP as well) on July 2nd. I received my 485 recripts and EAD Cards but no trace of my concurrently filed 140. 140 check also is not cached. All my applications (140 and 485 were sent in the same packet). Called USCIS and received the routine answer that 140 is not in the system yet and have to wait. Any one else in the same situation

I and my wife both have approved I-140. My PD is Dec 8, 2003 and my wife has Dec 24, 2003. I am applying as beneficiary through my wife's application. Is it possible to use my PD instead? Both are EB3.

take your i 485 application. There is a received date column and notice date column.
Date received is the date they received your application,notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08may2006 (eb2), but with a notice date of aug 30 2007 will get the green card earlier than someone with priority date of 20april2006 (eb2) with a notice date of sept 15.

Not good for a low volume India caller for me. I have ooma @$200 and I don't spend $200/year calling India. I use the 3.29c/min access number calling card (not the cheapest of all) and aided with all the promotions (Diwali, Independence day etc.), I manage to stay below $200/year mark.

Ok, I had hoped not to bite the bait, but I am human, nothing recharges and roils like someone saying "you are EB3, you are worthless compared to US the mighty EB2s".
The misleading continues
1) "VDLRAO" (no disrespect to his prediction capabilities) says EB2 will be current soon, so why are you raising this voice.
Well, if it is going to be current soon enough, then any action to redirect EB1 numbers should not be a cause of concern for EB2s should it? If you are going to become current soon, then it means there aren't many people waiting in the queue.
2) We should support the visa recapture
You all are assuming that EB3 does not support it. Unlike me, most EB3s are very active in calling, contributing and supporting those events. I have personal reservations about asking for a change in law when I am the direct beneficiary (I feel like those big oil companies who use their clout to get laws favourable to them, nothing wrong, just that I dont like to do it). Having said that, I have no problems in asking and demanding that the law be applied as written.
Once I have my GC done with, I intend to write to the representatives that barring progressive experience in the same company rule should be removed, because it is the experience that matters, not where you get it. Why should someone who chooses to be loyal be discriminated against another who has no qualms about his company's future.

Some within EB2 concede that the law is fuzzy, while others claim there is no basis for our campaign here. Well, there was no basis for so many things that IV has accomplished, and yet, most people accept that we are better off in some ways compared to pre-IV. If you believe the law is fuzzy, then you should realize that current interpretation is your luck, not your right.

So basically he is saying that count your blessings and thank god that you are stuck in Backlog centers or in retrogression because in Europe, its even worse. Its a nice way of saying : "It is what it is, take it or go to Europe or go back to India".

Does he know that the USCIS does not even have a clue on how many potential applicants it would expect if it moved PD forward by a certain period? Backlog centers are 20 years behind schedule already? People cant get drivers license in Pennsylvania coz they get only 1 year extensions on H1 due to labor backlog and their wives are driving them to work? Does he know that there is a name-check process that FBI sometimes takes forever which is not only hurting Greencard applicants, its also not a smart thing from security and public safety perspective to sit on someone's name check process while that someone is living and working on work-permit(EAD)? Does he know that the whole greencard process, being employer centric prevents people from switching jobs, getting promotions etc for 6-7 years? Does he know that Australia gives Greencard to all advanced degree holders in few months time who have 2 years masters from Australian university(accredited CRICOS universities) and allows students to work off-campus when they are on student visas?
