    I found this forum after my I 485 denied as I applied for AOS under AC21 at texas center on 12/31/2008. The first thing I did after joining IV is sent the four letters.

    With the June visa bulletin, my priority date became current. My Labor and 140 already approved. When can I apply for I485? After May 31 or before May 31.

    Can you explain more what is a processing date?? is this different from priority date?? what do you mean by retrogressed from Sep to Aug 06?? is this for all countries??

    For those of us who have become "current" with the latest VB movements, I have some discouraging news for you: at least for the Nebraska Processing Center, the current processing date for an employment-based I-485 has retrogressed from September to August,2006. Only a small step backwards but a step backwards all the same.

    They should have your info unless consulate hasn't sent it. they use your passport number as reference. so call again if they didn't use your passport number to search. in any case ping the consulate again.

    Thanks Bpositive. Actually this time I asked my friend in US to call DOS, and he used the computerized answering system with my petition number and they did say that my H1-B petition has been approved. I don't know if I mispronounced/mistyped anything when I did it last week, but at least now I'm sure that it is on DOS' system. Thats the same thing I heard when I called KCC, that my petition was approved in April 2007. Or maybe I should've asked them if they've access to PIMS. It's frustrating man, I never thought at this stage of career, entry-level that is, I will be stalled by things like this. Well I hope in the end I can find a rational explanation to why things turned out the way they did.

    For the new folks in the forum, its been 75 days and am still waiting for my H1 visa. I guess I should also talk to that Mexican Emabassy and see if my case shows up on the PIMS or not. The only problem with New Delhi embassy is that when I call them, all they say is that the case is still pending, and nothing else. I don't even know if I should curse them for being incompetent, or maybe that is all their job entails (I'm not being condescending here). Is it advisable for me to go to New Delhi personally? This is a mess, but as long as its in God's design, I'm ok with it. I just don't wanna feel later that if I had done this ... blah blah, then I could've expedited the whole stuff. That'd be a bummer. Well at least I need to be focussed and keep my head straight. That I can control, and thats what I'm taking solace in.

    For all the geniuses out here, how many companies like Google or Microsoft or yahoo came out of India in the last 20 years? Yeah, that is what I thought too.. BIG ZERO. But if you read J(erk) Thomas' response, one would have thought that India is full of competitors for Microsoft and Google today :D :D :D

    dude, how many immigrants/H1/L1/GC/Gc->US citizens work for google/Msoft/Yahoo. And if you are naming these corporations as the benchmark of success/technical excellence why do you not listen to what they say about visa programs?

    How do you guys know that 12K visas will be allotted in one single month(May)? From USCIS point of view, won't it make sense to keep some numbers as reserve, if the EB1 picks up in the 2nd half?

    I just got an email from the Chennai consulate, 29th day from the interview, stating the visa was stamped today:

    "Thank you for your e-mail.

    Our records show that your visa was issued today, January 31. You
    should be receiving your passport/visa soon.

    This means there is light at the end of the tunnel. Please have faith in your abilities, and in your God. You will hear back soon.

    Moral of the story: "Never use a Consulate in India for visa re-validation again."

    Please learn from this story, and never again trust Consulates in India for extension purposes.

    How do you know that experience in Canada or Mexico will be any different from experience in India? It can be only better at a consulate that hasn't yet implemented PIMS, which I don't think there are any at this point. At least you are at home with family. I think the worst is to be stuck in Canada or Mexico for a month. I think the moral of the story is to use AP whenever possible.

    It's possible that USCIS may issue a NOID instead of straight denial, when I-140 is withdrawn by the employer, if they have AC21 letter in the file. (It's a possibility, not 100% guarantee.)

    With a RFE/NOID you can continue to work while getting the issue resolved. Not so with the denial. You can't work till the issue is reloved, and you need to file MTR (costlier than a RFE). So it's basically a matter of risk-reduction though it always doesn't produce the expected results.

    I am sorry if I am bit late on this forum. Why even inform USCIS when you use AC21? There is no rule stating that you have to inform them , so why do it?

    On Friday, I got SMS from USCIS that my case is updated and I should check status online. I checked my email. I was happy :) to see an email from USCIS and opened it excitedly with butterfly in stomach. Well it said..

    "Your Case Status: Request for Evidence

    On September 10, 2010, we mailed a notice requesting initial evidence in this case. Please follow the instructions on the notice to submit the evidence requested. Meanwhile, processing of this case is on hold until we either receive the evidence or the opportunity to submit it expires...........
    "

    Looks like I have to wait more :D

    Everyone knows that increasing green card numbers will be best solution. In that also if we ask too much we may not get anything. Double the number of annual Gc plus exclude dependents will be enough for reducing retrogession but that may not eliminate. But waiting period of 2 to 3 years can be reasonable for most people. I am sure one more chance will come for increasing H1b numbers. That time we can try for GC increase also.

    But I am supporting the flower Campaign for protesting the VB mess up though it will not solve the problem

    You seem to be pretty good at analyzing faults in others' ideas and thoughts . What are your suggestions to acheive releif from retrogression.

    If I am correct, your PDs are current, right? Do you guys know if your case was pre-adjudicated and/or assigned to an IO? I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

    in resent SR, IO said my case is pre adjudicated and under review. we asked what's that mean, he doesn't know - if it's under review then how preadjudicated?
    i send request to senator before 2 weeks, but still no change in LUD and no reply.:confused:

    If you are offended, I don't give a DAMN!! I know about India very well and has been to India many a times. I know very well about the indian corruption which has no comparison with any country in the developed world. All you have to look at is the suveys from various NGOs that track corruptiy on at various countries in the world and you can see where India ranks relative to US or UK

    Hunter, Mind your own business. What is your point.
    1. We all agree there are loopholes in each and every system. Are you trying to fill 1% by punishing 99% of the people. If you want to fix loopholes this is not the right place to be. Go to the court and fight with the adminstration. Why the hell you are wasting your time.
    2. Considering you are a anti-immigrant, and you want to fix the system. Are you targeting Employment based immigrants or family based immigrants. Employement based immigrants are just 17% of the total immigrants whereas family based immigrants are more than 50+ %. better target them. Don't waste your time since you won't get anything as everybody over here are working and US employers want them.
    3. If you are unemployed, please spend your time in findiing a job. The minimum salary in US is around 8 dollars a hour so you have wasted your entire day. close to 100 dollars. You have not earned a thing by writing your thoughts in this forum.
    4. Senator Grassley and Durbin are working on your side and they also like you don't want a google, yahoo, ebay and other firms to suceed iin US. Be prepare to immigrate to some other country in future.

    Can we all take a month from his list of trancscripts and read through his transcripts and see which one has the H1B mistatement. I think he said this sometime in 2005 or 2006 we only need 24 participants.

    I m Aug-04, TSC, EB-2 .....still waiting!
    Opened SR 9/5/2009...got letter from CRIS...wait 6 months.
    For my wife , we got 60 days wait letter.
    I m the primary applicant!
    Has anyone ,tried to contact Congressman/Senetor's office?
    How can i do it?
    I m in Orange county, CA.
    I don't think calling Senator's office is going to be of great help. At least it didn't help in my case.
    You may google to find out the senator(s) for your state. Every senator must be having their own web-site. Get the phone # from their web site. Call them and tell them that you need help in Immigration and explaing them briefly. They will take your SRC # and contact TSC on behalf of you.
