How can the current position (EB3) relevant when the new employer is filing your GC for a future job (Eb2) ?
Does the employee need to get promoted in the current job to apply for a future EB2 job ?
Good Question. AC21 usage introduces a "Chicken Or Egg" situation. Our limitations 1) Till we interfile we have to show us fulfilling EB3 job calssification related obligations ( that also is a "future" postion in reality). Now if EB2 application is from "same employer" then that employer can logically produce the letter matching EB2 level experience after "real and natural skill progression" only to prove that you are fit for more advanced skill level job in other words after wait for 2-3 years.

I have a couple of very urgent questions that I want to check with you folks:
I am currently in the US on L1 Individual visa - my current visa is expiring on the 10th of March. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I have to be in India for a few days in March anyway. My visa interview is on the 11th of March.
My first question is: Is this alright? Am I going to have any problems because I did not extend my visa and applied for a fresh one instead? I have just been in the US for 5 months in my current visa.
Second question is related to PIMS:
I have had 3 L1 visas till date - first one was stamped in 2003. Second in 2005 and my current one in 2006. I have never overstayed and I was out of the US for 13 months before I came on my current visa in Oct 2007.
Will I face any delays due to PIMS when I go for stamping on Mar 11? I plan to be back and rejoin work on the 18th of March.

You or your employer should have a copy of all approved I-797 H1 reciept. Isint the l-94 on there?
Yes. But I travelled to India when I was on one of those I-797s and submitted the I-94 attached at the bottom of that I-797 while travelling out. I had not clue at that time that a copy of this I-94 would be needed.
I have other I-797s with I-94s attached at bottom coz I never travelled while I was on those I-797s.
Anyways, I am not worried. What I dont have, I just dont have it. Cant do anything about it now.

I raised SR on Aug 12th..No Response Yet...
Infopass appointment said that my file got assigned to Examination officer on Aug 4th...Not sure if Examination Officer and IO are same or not...
But the real kicker is i got second FP on July 26th, 2010 for Code 1...I didnt see any LUD after second FP...I am guessing this is where i am stuck with second time name check or back ground check verifications...
Also is it good to go for DHS 7001 form right way...i mean ombudsman request...
I will propose that you call USCIS customer service and talk to a 2nd level officer to find out the status of your case.. It doesn't hurt to pursue from this point.
I am unaware of any concrete proof that contacting Congressman or Ombudsman has actually helped directly...Most of us are just speculating on this.
I think you need to hear the fact that your case is assigned to an officer..Then it is just a matter of time.

Forget about it impacting desi companies, do you know how many companies will be impacted if the "no contracting" clause is retained in the H1B/L1 bill. It essentially means that no company can "purchase" the services of another company and use a H1B worker to work on the project at it's site. We are talking about biggies like IBM Consulting (where about 10% of it's workforce is on H1B) , Oracle consulting etc. who's clients depend on the expertise of the techies to help their teams by working with them onsite.
Oracle and IBM are rich by software support and consulting services, not just by their product lines.
Do business working on non-govt or non-defense apps care whether their contractor is on H1B or not? No they care about 2 things 1. Price 2. Can the contractor help get their system working?

Well, I am just stating facts. Just because you dont like them, I cant help it. You got to learn to move on. per country limit is 7% of the total, hence
140,000 * 0.07 = 9800 per country limit
9800/3 = 3266.66 per category if we assume that there are 3 categories. If we include EB4 & 5 the number is less than 3k per country. I think that this number is more accurate because most of the other blogs mention the fact that EB3 1 will get maximum of 3k per year if there is no spillover. My PD will be current if they set 5.5k per country for EB3 I, having been stuck in every step of this !@#!@ process i feel that the number will be around 2.8 (consular processing etc).
I am not considering any spill over etc...
