I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don’t have a valid US visa. (Note: If you have AP, and don’t have a valid visa, you still need a TV).
I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don’t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).
Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the “I will kill you right now” look on my wife’s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).
It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.
I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don’t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the “good feeling” that you experience during the days leading to your trip.
I haven’t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.

No body cares now for them when they come to visit India. This December when I was at domestic airport(small city), the porter came to me rather than going to a firang lady. Reason : desis give more tips now, like give 100/200Rs and the goras pay 1 USD :) and they know the maths.
Other incident, before boarding , a firang missed her baggage tag and when security lady asked for it, this firang was fuming and said it's their mistake. Now this lady cop, in her simple English said, Madam, please get out of this line, go to security check again, and get the tags, otherwise you won't be able to board the plane.
No one treats them as VIP any more back in India.

I got only one set of A# for both the applications. When I filed my second application I didn't have my A#. But we have mentioned clearly that there is another application that is filed on behalf of same applicant on MM/DD/YYYY.
You are lucky. Else the case goes for this conflict resolution and can take few weeks to resolve. If someone is getting such error they can post here and I can help.

Its been over 3 hours now that I informed CapitalOne that the discrimination is illegal. And as expected, no reply received yet.
First of all, they cannot ask you for you work authorization during the interview process. Second, even during hiring time, they can only ask you if you need sponsorship for H1 or not. If at this point you say no, then they have no business asking you for what kind of work authorization you have (unless the job specifically asks for US citizen or security clearence).
You should be able to forward the email to the local dept. of labor and also the Attorney General's office. What I don't understand is how TCS is in the picture. Is this a contract job that CapitalOne has outsourced to TCS? If it is, then they still cannot deny you a job because you have EAD. That is clearly discriminatory. All you have to do is show the I-9 form.

I am about to leave my employer and I want to withdraw my set (with wife derivative). Can you please help me with the procedure? And is it safe to leave the employer without effecting the other set where my wife is primary applicant and me as derivative.

are you sure you want to withdraw? All that you need to do i ssend a letter to USCIS indicating your receipt number. Make it clear to them that you want to keep the other one still going (mention its receipt numbers).
I would personally not withdraw simply because if they screw up and withdraw BOTH petitions, I can forget about filing another AOS for another decade...

I didn't get an email but got an sms from USCIS about the case status change to Decision. Here's the update :)
Decision
On October 13, 2009, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
Does that mean an 'Approval'. Between we moved to AZ from FL this week and I'm sending my AR-11 and changed the address over the phone. Is there anything else I need to do ?

I called FBI yesterday and asked for FP results. I was told they sent it to uscis and I saw LUD. Question is:
1) Does finger-printing & name check go together?
2) When FBI sends it to uscis does it mean nc/fp cleared?.
Any thoughts on this?

Ok, i will try to make it as simple as possible:
2 guys (names - JE and MBA respectively) graduate with BS in Engineering in 2001.
Both go to USA in 2002.
JE goes on H1B (as Junior Engineer) while MBA goes for an MBA on F1.
In 2003, JEs company files for his GC, PD 2003, EB3
In 2004, MBA graduates and joins a company as a manager.
In 2005, MBA's company applies for his GC in EB2, PD 2005.
So far so good.
Now, it is 2008. Both are still waiting for their GC.
Ideally, both are in same position (they should be, as both have same amount of exposure to professional world after undergrad - one replaced the work experience by higher degree and vice-versa).
Now, JE wants to port his PD and get into EB2 category with PD 2003. This will make him exactly 2 years ahead of MBA. If he doesn't port, they are approximately in the same situation, so the chances of them getting a GC in 2009 will be same.
What do you think is fair?
P.S. - I do not support this lawsuit.

I personally do not travel through a country that are biased and requires a transit visa for specific countries only. If you think about it, most of the international flights are full of us, Indians. If everybody (including Indians with GCs, that do not require a transit visa) start boycotting such airlines/country transits, then they will have to change this policy.
As I said before, I am never going to fly thru UK, even though I sill have a transit visa valid till Nov 2008. I can still feel the pain.

my spouse and i are july 2 filers. our checks got cashed yesterday. the lawyer emailed us all the reciept numbers. however, when i check the status online, it says that "our applications were recieved on october 2nd". our laywer tells us that this is not accurate and once the actual reciepts get to her, she will confirm. we are hoping that oct 2 is just the notice date and they have 2 july as the actual date!
will update once i have all the reciepts.

Dear..you seem to have gotten your GC..why the heck to you care..besides I applied ones in 00 and due to screw up attorney..had to apply again..also look in track it and immigration.com..there are people stuck from 99..please dont waste people's time by asking silly questions...

Do you know how much time it will take to get that status change? What if your PD is no longer current?
Yes it is a concern that I have to address. However I see 2 ways to work around it.
1. Travel out of country get H4 stamping done based on my current H1B status
or
2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.

I read on the murthy.com website that the UCSIS needs to go through the Kentucky Consular Center to obtain the PIMS verification. The number for the KCC is 606-526-7500. I am going to try and call them to see if they can give me any information on timelines.
For those people that have not left the US yet, it might be worth it to talk to your lawyers and see if there is any way you can have your names added to this database before you travel - that should eliminate any hassles once you leave the country. Much easier to try and do it from there rather than from here.

Thanks L1fraud guy for bringing up the details to complain. I have contacted the local office and proceeding with the process as outlined by the ICE officer. I agree with you and other members on this thread who say this fraud has to be stopped before it becomes uncontrollable.

Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Its not so simple though. Even after finding a good company to stick to, you should not make up your mind to remain stagnant. When you work for about 5 years, you will be faced with a situation where you are asked to take on more responsibility.
The way things are with the current process, if you want to progress in your career and take on a new challenge (eg: database programmer to a DBA/architect), that would require a new LCA since there is a significant change in the responsibilities.
Also at big companies, there are several lines of businesses which are structured as if they are companies by themselves. If you want to shift between LOBs within the same big company, that would also require a new LCA.

I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the local Congressman. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

also - all airlines work on a hub and spoke arrangement

One thing to realise is that direct point to point flights will take a while, and even then there is no guarantee that you will want to fly it because it may not be economical or convienient.
And the absence of point-to-point flights has more to do with the airlines following a hub and spoke model than with any government restrictions. Point to point flights were identified as a core part of Boeing's product strategy only recently. The situation should improve over the next few years as airlines take delivery of new models, but until then we are stuck with the hub and spoke arrangement.
We were very satisified with Continental even though we flew Seattle->Newark->Mumbai.

I have not completed 10 Years in the US yet, but this is an excellent idea and would support the same.
