I was just wondering if anybody knows about Science & Technology Related VISA Issuance Delay at Indian consulates and embassy. Is it a new thing introdcuced recently? Now they require you to fill up a 6-pages long questionnaire and wait 2-3 weeks delay. Anybody on h1-B has gone through this?

Notes:
If you already have applied in EB2 you won't be affected.
If you have a Masters you won't be affected.
I am EB2 India with Dec 2005 waiting. I think all EB applications should have fair short. So if a EB3 can become a EB2 legally, I think it is a fantastic thing.
I did not know about this rule. I changed employer in Jan 2005. My last employer's lawyer ill advised them to file me under EB3 in spite of the fact that the job paying off close to 200 k in compensation required B +8 and M+4 years of experience. I changed the job in Sep 05. Next company did the right thing and started the labor in EB2. I did not know about porting/interfiling otherwise my PD would have been Jan 2005. So even if I would have done a Port/Interfile, how am I at fault ?

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

I filed a G28 to allow me to represent my wife. I did not use an attorney. If you are filing for more than one person then I think that a G28 is worth it. It is a trivial form.

Restrictions on H1B is definitely not going to help retain jobs in America. More technnical jobs will be outsourced. My friend work for a TARP company and they are directed to move more technical jobs to offshore. The raid and other things what they are doing now will certainly prevent fraud.

I agree with what you are saying. But, we need to compare the taxes too. Not sure of the taxes charged by vonage when compared with teleblend.

If you put this in to mathematics, vonage may come out cheaper than teleblend. Additonally its much more established and bigger VOIP provider.

I'm not blind to stereotyping in this forum or elsewhere. It's not you vs. them kinda thing. You ARE stereotyping based upon some TRUE things but it is still stereotyping, isn't it.
Also, you understood some of my comments wrong. All I was saying is that due to big ISV's like TCS/INFY/WIPRO and mushrooms of bodyshops the actual worker gets pennies on a dollar and they keep the booty. So it's not the worker who causes wage depression it's the circumvention of the spirit of law that these companies do which causes it. I say "spirit of law" because they still stay within the legal framework. As far as offshoring is concerned it's a big discussion in itself and forces of capitalism and globalization are at work. None of us can prevent that but we can counter it by moving up in the value chain.
The scenario you described about modus operandi of big Indian ISV's is 100% correct but to generally imply that Indians are 1/5th as good as Americans when it comes to IT (50 member team vs. 10-12 member team) is a supremacist attitude and completely untrue.
It is true that the Indian counterparts are usually of much younger age but rarely substandard for the job. Companies realize that IT is no-longer considered rocket-science and they can save a few bucks. Try to think objectively keeping personal impact aside.
Now regarding overall economic input of immigrants there are issues broader and larger than you mentioned. Some of the smaller points you mentioned are true but you are completely missing the big picture. We can discuss that in a different thread :)
When Bill Gates says best-and-brightest it applies to individuals and not a VISA category, he's not lying. Among the 65K every year you'll find people from all skill levels, cream-of-the-cream to just-about-ok, and a few rotten-apples too. The immigration system is not designed to test skill level. Overall it's old, irrelevant and doesn't help anyone. It needs to be re-designed but unfortunately people are divided on fake lines and ignore the real issues or rather real solutions.
Although you have said it differently but you are right that solution to mine and your problems lie at the same spot, a modern, common-sense, immigration system that promotes best-and-the-brightest (Indian and American) and discourages exploitation.

Thank you very much for your update. Went to the Infopass today and as per the IO came to know that my case is in adjudication review and will get the interview. I don't know how much ombudsman will be helpful, but will try all options. My labour was approved in 2 months and I-140 in 18 days but it seems I485 is sturck for ever :mad:

I don't think it will do much good sueing uscis on this issue. The point is, they have the legal authority to be the one interporating the law. So, if there is "gray area" in the law, the law says it is their understanding that matters, not ours or any one else's. So, unless the law very specifically says it must be done in another way, you can not argue uscis did the wrong thing.
Now that we see the immigration law does not very specifically regulate how the flow should be like, so uscis have the authority to "understand the intention of the law" and act accordingly. You can't say you think the law means otherwise and thus sue uscis, because that argument makes no sense to the court. The court will only accept the argument when the government is apparently acting against the law.
We can definitely question them on how their understanding changed on visa spill over distribution.

I think we should concentrate on things which are beneficial for everyone - not only EB1-2 or 3 . We should get USCIS to improve efficiency, use all visas, get applications processed according to their PD and not randomly and above all do away with the country limits which is the biggest cause of this retrogression.
When there are so many big issues pending I wonder why not concentrate on them instead.
There are so many people from all EB categories whose I-140 has been pending for more than a year. Shouldn't that be a priority also because without an approved I-140 their GC will also not be approved even if they have a PD from 2001-2002.

This is ridiculous; all I see is unnecessary hurdles being produced � I see efforts of discouragement towards coming to this country on H1B. First they suddenly start auditing 60% PERM cases and now suddenly delaying visa unreasonably�increasing Visa numbers and making Green Card processing faster is aside, we are facing other problems.
I have started speaking with senior people at DOS. On a purely procedural level I don't see why an H1 applicant who may already be in the US is not 'security cleared' at the time of giving the I-797 approval. Totally ridiculous.
