Thanks for posting this I was searching for some advise on this aspect ....
I have one questions based on this comment :
If a person uses one of his I-140s and the adjustment is for some
reason denied, it appears that there is no reason why they can not then
re-apply for adjustment using the other approved I-140 providing all the
requirements are met under the petition.
So lets say Husbands 485 gets deined for some reason and the wife has an approved I 140 but her PD is not current any more, can the substiution still happen or are the couple doomed?
Please respond.

When IV can force CIS to change thier stand and listen, we can surely take this guy to task. Please come up with some plan. This guy is poisoning the minds of the American public with "Cock and Bull" facts, it's time he is put in his rightful place.

Called most of the people in the list.
Most of the time it was voice mail.
Person from Brad Sherman office mentioned that congressman was supporting the bill.
Person from Robert C. Scott office mentioned that she did know the position but the congressman has supported these kinds of bills in the past.
Thanks aadimanav. Other please call.

I'm not getting this. If DOS/USCIS wants to retrogress the current dates then why they will wait for july2nd or 3rd. As they know people will file their applications by 29th june or they will try to deliver their applications by 2nd of july. So,if this rumour is really true then they would have posted revised bulletin in this week only , latest by today only, so that people will stop filling applications. So guys relax and keep doing whatever you were doing and file your applications by 2nd july.
There is nothing in our hands or even in lawyers.Lets wait n watch!!! keep hope
I was thinking on the same line. Why to wait at the last moment and that too when today they allowed the medical examinations to be done outside the local area. I guess, time to chill out, have some beer (i'm already having) and worry on monday. We anyway can't do anything about it on sat-sun.

Hi,
I am currently working in Skilled visa through one of MNC company.I am working for this company for last 4 years and prior to this company i worked in another small company for two years. When I join my current company i provided all the legal document like exp, last two month pay stub and releiving letter and they did BG . They did not find anything wrong with prior employer in last 4 year. recently they found something wrong about my prior employer and asking me providing additional document and unfortunately company is closed or rename. I have told my current employer that i don't have any more evidance of my prior employer.Because of this reason they are asking me to come back india.
Is there any way that i can take legal action against this company in US because from last one week
they are harrassing my like anything.
Please let me know if anyone come across in this situation.

Yeah, am using a cordless phone. I dont remember but even with corded phone I guess I had this issue. And the cordless phone is DECT 6 phone which shouldn't interfere with the wireless connection that is at a different frequency.
And what alternatives do you feel could solve this problem?
If you are using a cordless phone - use 5.8 GHz. The lower frequencies interfare with other wireless devices.
TryThis deal starting from Oct 11th (http://www.fatwallet.com/forums/hot-deals/957955), or maybe this one if you are lucky (http://www.fatwallet.com/forums/hot-deals/957963/)...

I guess only a minority of people get stuck in name check ( unlike immigration portal forums , the FBI namecheck discussion thread doesn't move much) or may be that majority still in the 'waiting for receipt notice/FP' mode.

We are in US for past 7 years in H1B. Since the priority dates are current now we are ready to file I485.
3 years back my wife's status went out of status for 7-8 months when my employer renewed the visa's they forgot to do H4 and we didn't noticed it.As soon as we found it our attorneys did the Amended H1 and got her H4 status back to current.Since then her status is current..will there be any issue because of that when we apply 1485,EAD for her.
Please let me know ...
Thanks

If this information is correct then we are in much better shape then was being projected. what is scaring me is the number of applications that are pre 2004 the number seems to be pretty big? are these abandoned applications. Also does any one know this report is current as of when?

There are 37275 applications with PD of 2004 or earlier. Can we make an assumption that about 20 to 30% of these would try to port once economy turns around in the next 18 to 24 months? How will this impact wait time for a EB2 with PD Jan 2006?
I am really disappointed in the info provided via the foia effort. It told me that there are only 4118 applications before me. 4118 vs 28074. Worst kind of sick joke.
Based on the PD on my 140 Approval Notice (May-2004) there are 28074 applications before me. This is the correct date.
Based on the PD on my 485 Interview Notice (Aug-2007) there are 53192 applications before me.
I do not know how my application was counted when the data was put together.

As it has been 85 days since my 485 reached in NSC and updates, so I called the 800-375-3283 and transfered to IO, she was very polite and told that now they are taking 120 days to issue receipts. ( ware...waa...how fast service)
As CAA dude post a 800-246-8253 this is Custom #. (lol)
So they started to say now all we have to wait for another 30 days, there is no other way to get the receipt #, she said call once in a week if u are lucky, u may get ur receipt #,
yes sending fax, e-mails, create a query this make sence to invistigate the pending application.
Ok again ur count down starts against 120 days..........

Near the start of his Nov. 4, 2003, program on CNN, Lou Dobbs said, One-third of the inmates now serving time in federal prisons come from some other country one-third. Later, he offered more details: Coming up, were going to take a further look at the impact of illegal aliens. And it is an expensive proposition, particularly in our nations prisons. Illegal aliens, those citizens noncitizens taking up a third of the cells in our federal penitentiaries.
He also said that illegal immigrants were an increasing part of Americas prison population.
Here are the facts, according to the Department of Justice:
In 2000, 27 percent of the inmates in federal prisons were noncitizens. Some of these noncitizens were illegal immigrants, and some were in this country legally. In 2001, this percentage dropped to 24 percent, and it continued dropping over the next four years, falling to 20 percent in 2005.
Bottom line: illegal immigrants make up significantly less than a third of the federal prison population, and the share has been falling in recent years.
The share of state prison inmates who are noncitizens is much lower. (This is largely because immigration violations themselves are federal crimes.) In 2000, 4.6 percent of inmates in state prisons were noncitizens. This number remained quite steady over the next five years, right around 4.6 percent.
Over all combining federal and state prisons 6.4 percent of the nations prisoners were noncitizens in 2005. This is down from 6.8 percent in 2000.
By comparison, 6.9 percent of the total United States population were noncitizens in 2003, according to the Census Bureau.
Anne Morrison Piehl, an economist at Rutgers, says there are a number of reasons that immigrants have a lower crime rate than the native-born population. (To read a paper by Ms. Piehl and Kristin Butcher on immigrants and crime, click here.)
For one thing, the consequences of being arrested can be enormous for illegal immigrants, which is an obvious deterrent to crime. For another, immigrants, as a group, arent typical of the population. The fact that they have picked up and moved to another country suggests that they have more ambition, and perhaps even more skill, than the average person. This could help explain why the United States, a nation of immigrants, is such an economic powerhouse.

Re-route the flower from USCIS to the two hospitals makes the flowers go steps farther and will definately make bigger noise to get attention. That is great.
guys where is the whole EB-Retrogression message in all this?
We are getting carried away and forgetting the main reason this campaign was started: draw attention to EB retrogression, USCIS wastage of visa numbers etc
