Following info may useful who are looking for SSN on H4
Below is part of a message I posted in another discussion, but this deserves it own discussion. If you are a legal resident of the US, such as an H4, even if you are a child, and you have an ITIN, you can get a Social Security Number, because that is the only way to get the Economic Stimulus Payment.
Be forewarned that the SSA will put up road blocks. You will likely be denied your first application. However, the law is clear and there is no cost to apply. You also have a right to appeal. A cover letter explaining why you have a RIGHT to a Social Security Number will help support your case. Your letter should refer to the laws and statutes cited below.
The only way to get the stimulus payment is to obtain a Social Security Number for "non-work" purposes. The SSA may issue an SSN to an alien under the following provision:
20 C.F.R. � 422.104(a)(3)
(i) You need a social security number to satisfy a Federal statute or regulation that requires you to have a social security number in order to receive a Federally-funded benefit to which you have otherwise established entitlement and you reside either in or outside the U.S.;

It will be phased out for taxpayers above those income thresholds. Taxpayers may qualify by filing a tax return for 2007 and including a valid Social Security number on their tax return." Someone referred this creditunion in this post and when i checked the rates, they seem to be better than dcu.org.
When i checked the eligibility criteria to join penfed, its vague and it seems that if i join military officers assn of america for 13dollar annual membership(which i dont need to retain) , i can get their membership. Is this correct?
If i get membership with this moaa, would that hurt my greencard process as the greencard assumes no affiliation with any military associations etc... (i remember some questions like that). Can someone please advise ?

I believe the USCIS counts only applications they have recieved. In other words even if there is a 140 approved but the person is not able to file a 485 then his application would not count. I think they log in the applications when they send out the reciept notices and then log them out when approved. As such I think even pending EAD and AP applications would be counted as cases.
However some clarification would be definitely nice.
I want to point out however that there are many cases of 140 approvals who for whatever reason are not active or transferring to another petition.
The BECs have completed a little over half of the cases to date. They are moving quite fast in the last few weeks. Recently a colleagues application filed in May 2004 got approved, within 3 weeks mine filed on the same day with the same lawyer was also approved (atleast online status check). As such I feel that atleast those that filed with RIRs will be done by the end of the year and those with traditional labours will be done by next year. Now that last point is what gives me the chills. Those are the really old PDs and until we get a feel for how many of them are still active and how many are legit and how many of those are used for Labour Subs etc, we will not get a handle on the size of this problem.
At the very least we can double the number of pending petitions at 485 stage. Also atleast about 30-40k of those with background checks pending are probably EB based. So It would be a guesstimate but there may be about 300K or so back log of visa numbers needed. However of those a disproportionate number would be EB India. I would conservatively say a third. All guessowrk of course.

One of my friends had similar denial. He approached Sheela Murthy, they did appeal MTR for him... later he got approved... Make sure you go with a good lawyer who can bring you out of the situation... I know, it would cost you little money but it's worth trying especially if your PD is pretty old... BTW, what is your priority date and 140 filing date?

I saw some of your suggestions in this thread. I need your suggestion on my case. I applied my 485 in July 2007 with an already approved eb3 I-140 (PD: May 2004). At that time, my 2nd EB2 I-140 was also in process but since I was not sure so I applied 485 with eb3 I-140. Later, I received my eb2 I -140 approved with the same PD of May 2004. Thus , I was able to capture my original PD (most difficult task!!). Since then, I and my lawyer have been sending letters to USCIS to interfile my eb2 140 with pending 485. We have not heard anything back from USCIS so far. I had opened congressional enquiry also and they also could not get answer from USCIS. But, congressman office told me that USCIS indicated that they will take most favorable 140 while adjudicating my case. They also suggested me to talk to them again when my pd is current based on eb2. Can u suggest as to what else can be done in this case? I appreciate your answer in this regard.
