There are no EB2 positions available for the Software professionals, only EB3 positions are available. However as we discussed earlier if the company has a business necessity and are able to produce the documents for the business necessity you can file the case under EB2, which is still beyond the requirement according to Labor Department.

Looks like Satyam is worried about upaid case. They are not able to digest paying billions of dollars in court settlements. Hence the drama.

I don't know if I didn't understand this right but one of my friends came to U.S like 5 yrs back in 2002.
Never left the country fo far.
She came on H4 and at that time her I-94 was till Apr/2005.
She got H1 in 2004 with new I-94 till May/2007.
Got her H1 extension( with new I-94 dates.)
The I-94 she got at the port of entry expired but her employer told her it is not a problem as her H1 has a I-94 with new dates.
I know in your cases(s) you have passport expiry thing. But I guess it's still the same right. I gues your H1 will have new I-94 in it .So what is the descrepency?
Please let me know .

My experience was just great. My company had inhouse immigration deptt and their own attorney as employees.. She was just great and very transparent on every process. She sent all the documents and updated my at every step on where I stand.
I really respect that lady, who was doing way beyond her job profile to keep us updated and well informed. never paid anything for the attorney service or GC filing except a one time fee of $500 when the company hired some attorneys on contract to get over the overwhelming request during July fiasco. The attorney also adviced me and guided me on how to leave the company and what is AC-21 and how to do that. So gave me a lot of pointers on how to choose a new attorney. Though I had a lot of conflict of interest with my company policy and management, one thing I always appreciated about it was that their healthcare and immigration was far better than any company in US. Now I heard its not great and employees have issues related to this. I paid on $15 for the delivery of the baby and that was the total amount I paid in 9 months .. thats it.
The crux of the story is , when choosing a company , initially these things really dun matter but in the long run these are things that really matters, I would suggest everyone who is switching the companies, make sure the company has the right healthcare plan and immigration services. Do not hesitate to discuss this with the HR. I always do and make it clear, whenever I am questioned by HR , I just tell them , "The company has selected me but I haven't selected the company yet." The HR also has the pressure to close the position they will provide you with all the different options. Do not always run for the $$$ a few 1000 $$$ doesn't make the difference as at the end of the day those also shrink with tax and deductions, but the perks like these stay and pay more than $$$

I'm 15 and I have done several jobs .. they generally don't mind you being that young, most of the times they're amazed :D You have to talk decently etc, like Rev said. Nohing much can go wrong if you make a good, professional impression.

That is expected based on the number of I140s that would have been approved and ready for adjudication. Also, with priority dates moving forward, more applications from earlier dates come into play and the processing dates move back.
Hopefully, they start moving forward soon and go over the July / August 2007 hump.
With USCIS what isnt odd! :).

All of of this, writing to the president, congressman/congresswoman are fine, but PLEASE, PLEASE make sure, that the following are adhered to:
(1) Address the President as "Honorable Mr. President", and not "Hello Mr. Obama"
(2) Please please please apply spell check and make sure that your letter/email/fax is grammatically correct. All of us claim to be "best and brightest" and "highly educated", but having seen the composition skills and grammar usage of a lot of us here, on IV, I would higly recommend having another person, who is more competent in the PROPER use of English language, take a look at whatever you write.
(3) It would make sense to send letters (several thousands of them, if possible), to the President, on the same day. Even if a handful of these letters make it to his desk, each with same/similar content, but from different people, he just might notice it enough.

My PD is in Feb 2005, hence downloaded the 2005 MDB, did not find my case in there and to my surprise haven't seen any cases from the backlog centers. The database for 2005 contains only 14000 records, can't believe there are only 14K cases filed in 2005. Am i missing something ?

Employer has to show that he can support all the employees that have an 140 pending. It cannot be attributed to being sadistic alone.
However, having an official AC21 process would be good.

EAD document - at least that's how it is in GA. The license will be valid till your EAD expiration date.
Also, in GA, if you are not a Citizen or a Permanent resident, you cannot renew our license online.
What if you are working on EAD on pending 485? What would be the acceptable document?

3 year degree is not a advanced degree. (Here will consider as 3 year college studies- may be comparable to an associate degree or greater)
Diploma is not considered for GC. It is useful for H1B.
Try in EB3. Still not give 100% guarentee.
They need 4 year single source education/degree, for US equivalent.
My friend with 3 year degree + 1 year B.ED degree + 2 year MSc denied for EB2 for education. Evaluation done with most advanced evaluator. Still denied, now on appeal with AAO. Even with 6 year total university studies not accepted. How they accept your 3 year degree.

It says NSC is slower because they have extra VSC cases to deal with but would improve significantly once they are done with VSC cases in future.
My I-140/I-485 was filled in June 2006 too and its being processed in NSC. All we can do is wait and watch...

Just heard on CNN that CIR is back on the Senate floor for sure. They have agreed to some compromise. We need to watch our for what has been agreed to and make sure that our requirements are not missed out, else all we will have for ever is a PENDING 485 APPLICATION
