    Please help me. There is no LUD on my status online. I had my finger printing done on sept 19. CODE 3. For both my husband and me!! I don't see any updates on the status online. Can someone tell me what I should do? FBI says they sent the prints the same day!!!!

    Am I stuck in Name check already?? How do you know this?????

    I called customer care USCIS, they say they don't have information regarding finger prints and you don't see updates regarding fingerprinting online. Is this true?

    PLEASE HELP. YOUR ADVICE WILL BE VALUABLE TO ME IMMENSELY

    OK. If you read my posts I'm in the same boat, no LUD after FP. I called FBI finger print number and verified the results were sent to USCIS the same day. I didn't call USCIS. I was also worried like you about getting stuck in Name check. I joined the Yahoo Name check group and one kind individual answered my question (thanks John). See below.

    FP and namecheck are independent.

    a)FP checks
    your fingerprints against FBI fingerprint
    databases and the result comes back within couple
    of days (or maybe even one day).

    b)fbi namecheck
    compares all combinations of your name
    against FBI national namecheck program database
    (86 million records).
    This one comes back faster (they say less
    than 6 months) if there are
    no hits , but if there is some hit ....then
    human person needs to clear all hits by requesting
    copy of the paper documents from any /all
    of the 250 FBI offices across USA . So this
    is time consuming process and some of us have
    been waiting for over one year , two years , three
    years etc.

    the LUD thing has no significance. you cannot
    interpret much from lud and it causes
    unnecessary anxiety . some people don't get any
    luds from receipt date until approval.

    try a service request first to find out if your
    namecheck is pending .if you get a letter saying
    "processing of your 485 is delayed because
    investigation into your background remains open"
    or something like that , then it means the namecheck
    could be pending !

    We are not here illegally. We are proud to be highly skilled, in demand and in America to improve American competitiveness.

    The National Anthem was sung (and thank you Panjak, you brought a tear to my eye) as we are waiting patiently in line.

    It was sung as a mark of respect to the country of which we aspire to eventually become citizens of, and that play host to us. Its the same reason we held the American and State flags up high and proud during the walk.

    Thanks Jatinr for your inputs.

    Unfortunately, Canadian authorities don't take I-94 as it is nothing to do with them and don't pass it to US CBP.

    Even if I come back - may walk to US border point to return I-94, the issue is not returning I-94 alone it is the date of leaving as there won't be any stamping or any record of leaving.

    Call the office and tell them you did not get the answer to the questions and issues you raised and want to speak with the person who handles immigration policy matters. Follow up with this person. Letters go to junior staff and issues get lost unless you contact the senior staffers and seek appointment from them.

    Gurus,

    Here is my situation:
    I-140 approved - PD: May '06
    I-485 filed - July 30 '07 (India)
    EAD cards - Received
    APs - Received

    Due to a slowdown in their business, my employer is laying me off in Dec '07. I'm still short of 1 month to complete my 180 days of I-485 filling. However, they said they will not withdraw my I-140 and, to help me, will in fact keep me on their payroll until Jan '08, with my Jan '08 salary as my severance and my official status as on "paid leave". So far, so good.

    I also have a job offer, and my new employer wants me to join them in Dec '07, on EAD. My question is: Can I be officially on the payroll of two companies simultaneously on H-1B and/or EAD? If yes, do I need to inform the USCIS of my status (new employer; AC21)? My other option is to say No to the new (attractive) job offer (or to try to convince them to wait until Feb '08, which they'll likely not agree to), and and take up another job in Feb '08, on EAD / H-1B transfer, using AC21. Please advise whether I'm fine with using the first option!!

    I don't think there is any rule stating that you cannot join a new employer before finishing 180 days of AOS pending. I joined my new employer as soon as I filed my I-485. Although, I transfered my H1B also (did not use EAD).
    If your previous employer has assured you that they will not revoke your I-140, then I think you can freely go ahead with your new job by transferring your H1B. Although, USCIS will not give you a 3 year H1B extension because you have already filed AOS.
    I am in exactly the same situation as you are, in fact I have already jumped into this new boat quite some time ago.

    There are 2 separate issues here..
    1. Do you HAVE OR NOT a job with this middle vendor, from your description below seems like your prior employer waived Non-Compete part of your employment agreement to you and you just quit that position?
    2. Technically you are still on the payroll of your employer?? He's sorta right, if you are on OPT, he's not legally bound to inform INS of the termination, and terminating employment does not negate the 12 mo. non-compete you signed on.

    I agree with other commentors here, you should move on. In your case, moving on would need,
    1. Make sure you got paid for actual time you were on the contract.
    2. If you haven't already DO NOT QUIT THE JOB under threat of law-suit. In fact Non-Compete viability depends on state of employment. In CA it's impossible to enforce. Even if he sues, there better than 50/50 chance you will win due to "undue duress" clause that negates it.
    3. Threaten him that you will go after him and his H1bs. Get a lawyer (spend 500$) and send him official letter. Since you are in CA and he's in NJ, even more troublesome for him is to attend small claims court dates.. go to local court and ask for jurisdiction there.. make sure to include name of OWNER in the law-suit,

    Basiically don't be scared, don't get mad, get even..

    Hello Everyone,

    Hi I am a student in United States and I was on Optional Practical Training from Jan 2008
    to Dec 2008. As I finished my OPT in Dec 2008 I joined again in New course for M.S in soft. Eng.

    In the month of November I got a job in California through an employer, who is based in New Jersey. As I got a job the employer asked me to sign a contract which states that I will be paid 60,000 per year and I shouldn't work with his clients for 1 year after the agreement is terminated.

    As the project was only for 40 days I finished it successfully and I my employer couldnt find me another job till now. So I decided to work on my own when I got an opportunity with the previously worked vendor, when my employer came to know about this he has threatened me to sue me. Then I retrieved from the opportunity but now even my employer doesnt pay me anything. It is been 4 months, he hasn't paid me anything , even he hasnt provided me any insurance.

    I asked my employer couple of times to terminate my agreement otherwise I would go to Department of Labor and claim my wages but he downplays that by saying I am not on H1B so I will not be paid unless I am working with Client. But the agreement didn't say anything like that.
    I have even asked him to run the payroll where I worked .I.e in California but he ran it in New Jersey. When I pointed this to him he said the payroll will be run at the residing state if the employee works more than 6 months.

    We had an argument about this but he never replies to my emails he only calls me and says whatever he wants to say but when I ask him to put whatever he has said to me on phone in an email he doesnt reply at all.

    And to mention, he doesnt have any documents of mine. I even didnt fill any I9 form, what ever he has is the only agreement that I signed and social security number that I emailed him to run my pay roll.

    After the argument I even requested him to send my original agreement signed by two parties. I only had the agreement signed by me, he even didnt send me the agreement with his sign on it even after repeated requests.

    Now he doesnt even care to answer my calls or emails. I am really tensed. I am getting opportunities from vendor that I worked with but I am afraid he would sue me. Please help me What to do. I am really really frustrated, tensed and I can't express how I feel right now.

    I want to get out of the contract and work with the vendor if Possible.

    Please explain me how can I tackle this problem?

    i think "same or similar" job is common sense thing to keep in mind. You dont want to specialize in software architecture the switch to building construction architecture ;) also remember that if you need an attorney to defend you, it will cost you more in money and peace of mind. So it is better to stick with what you know, if you know what i mean.

    In answer to your question, no - you do not need any supporting documents from your new employer except in the case of filing an ac-21 letter which must come from your new employer.

    So you can apply to any jobs that say employers cannot sponsor visa or gc because you are not technically seeking their direct support for your pending i-485 adjustment. If they ask for proof of employability, present your ead (formally called form i-766) and you should be good to go. Ead form i-766 is listed as a list a document on form i-9. See item #4 on page 4 of this document:

    list a means you need only present this document for employment verification. You don't even need to show any other document such as passport, driver's license, old h1-b, etc.

    I was in a similar, but slightly different, situation. I got my 3 year extension while my previous extension was still valid (a couple of days left).

    So at the POE, the officer gave me on the I-94 a date that was 3 years from the date of entry (that's the max their system was designed to handle) and said that since I have the visa on the passport, the next time I reenter I would get the later date on the I-94.

    I just received an email from USCIS that my wife's EAD has been approved.

    RD 07/02, FP 09/04, PD 05/06

    Is approved the same as "card ordered"? Do you see a different LUD than the card ordered LUD?

    you might also need a copy of your approved Labour application.
    I am not sure if you can get the documents directly from the UCIS becuase the documents belong to your employer and not you.
    you can try through Freedom of Information Act(foia.com). but it might take a while to get the documents.
