I had a tough situation in my life and i was in this scenario and came out.
I consulted a debt services company and they settled it for me and repared my credit score. but, i had a serious intention to clear the debts.
normally the creditors go to court after 3 years, so talk to them through a company or by urself if you are ready to settle. If you settled like 30-50%, the creditors will send I099C and you have to pay tax for that...

My H1B is valid till April of 2008. When i went for vacation and entered the country in March 2007, the guy at the border patrol did some mistake and put the date on I-94 as 16th sep of 2007 instead of April 2008.
I tried to get it corrected at the local CBP office but could not do it ... So i am planning to make a trip to Canada before my visa stamp expries to get a new I-94 which is valid till April 2008.
But since i have sent my passport for renewal, i am not sure if ic an make the trip bfr my I-94 expires.
And also i am not sure if i can file for extension of my H1B as it is more than 6 months ( it is about 10 months eatly) before the expiration date on my current H1B.

OK, now I see your problem. You did not tell us about the error on the I-94. This looks like a question for your attorney.

Is there any conflict between 'India being great' and your 'GC application'? Its really not a smart thing to say that you missed it on purpose when your name is 'PERMFILING', you have 'EB2 in process' and you appealed on your EB1 application. :D:D:D

As per Murthy's announcement AILA finally managed to get the required number of Plaintiffs by 2:45 PM today after noon.
Still to be on the safe side shall we go ahead fill the PlainTiff form ??
what if the lawsuit is not given " CLASS ACTION " status and only Plaintiff's are benefited ?
Is there any potential advantage for AILA if they upgrade the status as CLASS ACTION - do they get any Money ??

The court may or maynot give benefit for all classes .so better file and be in the "Best Class" where if AILA wins the case you will get benefited ,Dont be penny foolish as if you already spent money in getting other stuff ..what you are loosig in 1 grand for attorney fee , ( think of desi employers who gets 2 grands every month on you )
Also with todays's rumor some thing positive is in pipeline ..even july VB flip-flop also started as a rumor

Hi all,
I don't believe having I-140 filed by a company constitutes a violation of beneficiary's non-immigrant status.
To be eligible for the student status, among other things, you must demonstrate non-immigrational intent, that's true. When applying for a visa and going through immigration control at the port of entry, the burden of proof is on you. Therefore, the chances of getting F1 visa or being admitted on F1 status with I-140 filed are very slim. Nobody will believe you are entrying to study and go back when you have approved labour and I-140 pending (or even approved). Once you inside the country, however, INS have the burden of proof in the status violation cases. And for them to proove in a court of law that you violated your status by changing your intention to go back would be impossible without some sort of open confession and signed affadevit from you. So, don't worry about it.
Person's intentions change over time, there's nothing wrong with it. Peolple file adjustment od status applications all the time: B1 to F1, F1 to H1B, etc. Filing I-485 from student status, or from any status, should not be a problem in itself either, as that is precicely what you are declaring by this application: "My intention changed, I don't want to go back anymore, please adjust my status to Permanent resident".
There is a potential problem here, though. If you apply for a position and initiate LC process shortly after you entered the country on non-immigrant visa, you might be giving INS in future a reason to suspect that you were not truthful on your original non-immigrant visa application, and your "real" intention was not study but work in the USA. That's where there could be trouble, as if they are sucsessful in prooving this, it could lead to deportation and lifetime ban. Per my lawer, the safe time to wait before initiating any status changing process is one year.
My personal situation: I was on F1 visa for 6 years before I started LC process with a company for a totally unrelated to my field of studies position (EB3). We had PERM approved and filed I-140, with me still on F1. I-140 was approved and now we are stuck in retrogression. Meanwhile, and after I-140 was approved, I graduated and applied for H1B based on my major. I have disclosed on H1B application that I have I-140 approved from another company and attached a copy. Not a question asked. H1B was approved within 9 days (cap exempt). And there's more. Because I violated my F1 status years ago by accepting unauthorized employment (tracable through taxes), my lawer told me to leave the country and re-enter, to cut the tail clean and be eligable for adjustment of status when the quotas open up. I went to Canada, and applied for H1B visa stamp, disclosing on the applicqation that I have I-140 approved and have violated my visa terms previously ("yes" to question 38, in "kiss of death" section of the application). Very stressful time that was. But in the end - no problem, got the stamp and was back in two days.
Anyway, sorry for the long post. I hope this helps.

SOP - Tell your congressman you got approved with the same day as your spouse and there are people who got approved in the later dates as well. Ask them to follow up with USCIS with the same. If not since USCIS has sent this info in written, tell them you will take legal action, if this is the reason.

My I 140 got approved just after moving to company B
My old attoney only filed I485 with old labor and I 140.
To summarize your case, you got your LC approved from company A and filed I-140. Then left company A and joined company B. You got your I-140 approved after joining company B so your attorney from company B applied I-485 based on the I-140 approval from company A. Did I get this right?
If so, I hope you are not currently working on EAD. Only way you can save your I-485 petition is if you can get an offer letter from company A stating that you will be re-hired upon GC approval. I hope this is possible and I wish you good luck.

I went to Chennai US consulate for my 7th year H1B visa stamping. Without verifying any of my docs which took it with me, VO just issued 221g green slip and asking all petitioner's docs....
Here is more detail about my case.
1. I am working for a small company < 50 employees as a full time employee, since 2005.
2. I am the only one H1B in my company ...
3. My company was acquired by our competitor and name got changed ...
Here are my concerns
1. If they have any concern / doubt about me / petitioner, Why dont they clear it before approving I-129? Now DOS is sending back all the 221g cases to USCIS only for further verfication. So does it mean USCIS is not doing enough verification before approving I-129?
2. Can IV team / Experts help to rectify this too much of back and forth b/w USCIS and DOS?
3. If my visa is rejected, How do I vacate my apt, selling my car?
4. What will happen to my son's school? i.e. How do I transfer or continue his education in India...
5. I would suggest all the H1b people to think twice before going for visa stamping in India.

My wife and I went to India in Jan 2011. We both are on H1 and work for the same employer. My company is a 150+ employee IT firm. We both went separately for our Visa interview to Mumbai Consulate.
When my wife appeared for Visa stamping, she was asked questions about her job, education and company. After her interview, the consular gave her the 221g form that requested all the employer details (tax returns, audit statements etc. ). So when I reached India, I carried the documents for my wife and similar set for myself. She appeared for the interview again and after reviewing the documents the consular approved her visa. Our immigration lawyer mentioned that it might take 2-3 months - but this was quicker than we initially assumed.
When I appeared for the Visa India, I was asked questions about my education and how am I on my 7th year of my H1. Once the consular noticed that I have filed GC and the 7th year extension is due to my I-140 approval, she issued me a 221g form and mentioned that my case is taken in administrative processing. They didn't give any turnaround time for the processing. However, I received email from consulate after 4 days to submit my passport and my visa was approved.
I noticed this has happened with most of the friends I know were visiting India for stamping. And the 221g form is issued to anyone, irrespective of IT or Non IT field, Small or Multi-billion Corporation. A friend of mine who is working in biggest telecom got 221g, another one working for Research Hospital for 221g, then one in a Biotech firm and in Manufacturing firm - all non IT got 221g
It will take it's course and you should get your approval. All the Best !!!

least $20,000 per visa, the US Attorney's Office said.
Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.
The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.
The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.
Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.

Mahendrakumar "Mack" Patel, 55, Rakesh Patel, 36, Alberto Pena, 38, Bernardo Pena, 38, and Marte Othon Villar Sr, 48, encouraged and induced the illegal immigration of Indian nationals in exchange for tens of thousands of dollars per visa, a statement from the US Attorney's Office said yesterday.
The jury found that Alberto and Bernardo Pena, twin brothers from Brownsville, along with co-defendants had encouraged and induced 87 individuals from Gujarat to unlawfully enter US on temporary H-2B visas, knowing that the Indian nationals did not intend to work for the company that was used to get visas for them.
The brothers also knew that the visa-seekers did not intend to return to India when their 10-month visas expired, a statement said.
Pena twins also travelled to India to assist the Indian nationals with the application process and visited and corresponded with the US Consulate in Mumbai.
