When did you file? did you labor approved?
could you give me an example, how you changed your role and responsibilities for eb2?
If your eb2 gets denied, hope you have eb3 keep running as it is right?

Im on 4 ye H1b .and have option to change employer and also have option to keep the same employer and work for another employer at the same time .

There were few employers too who attended the rally because they believed in the cause.
I spoke to a French guy, forgot his IV handle, he got his EAD recently, he flew all the way from Miami, he googled up immigration and found IV 2 weeks back, looked at the rally stuff and came and attended the rally.
Hats of to all these people who have respected IV with passion.

Hi,
My parents will be here for more than 184 days this year (on visitors vis) and I want to claim them as dependats on my tax return for next year.I searched through some old threads, but the info seems to be outdated.
* Can I claim them as dependants on my tax return?
* Has anybody done this successfuly before?
* What is the deduction amount per person/dependant?
* What is the process? I know they will need an ITIN etc.

U have 4 yrs degree.Ability to pay not an issue.No exp needed.This 3 are major RFE.So nothing fit for u.So maybe some minor issue.So relax.one of my friend got RFE 2weeks back but still didnt receive Actual RFE.his RD is nov15th
or Can the RFE juz verify with my employer whether the position is still available to me or not ??

Here is what we learned from my case, please feel wordsmith it and put it on wiki -
Some History:
My PD - Feb 2003 EB3 (140 was marked for CP)
May 2007: EB3 dates move to May 2003 - my lawyer prepared for June 1st filing of 485
June 2007: My wife's PD of April 2004 EB2 (140 was marked for AOS) becomes current - her lawyer starts preparing to file for 485.
We discussed the situation with our lawyers (but we were sure we would go with what my lawyer advices, she always gave good advice - both the law firms are very reputed and well known)
My Lawyers advice: Do not file both 485's at the same time, if the files get assigned with different alien #'s it will be very difficult to get the cases merged. Files could land up in two different physical locations etc... basically huge possibility of delays
Her Lawyers advice: We have not come across such situation, we think we should file anyways.
Our decision: File my set of 485 as we could do that on 1st June itself and apply for EAD for some relief! and not wait for July 1st (at that time we thought with was the best - better file what's current)
Interim efforts: Again discussed the situation with my lawyer as things were not moving, we discussed possibility of changing my wife's AOS application to CP - since dates became unavailable, we though we could probably capitalize on switching to CP with the hope that the files will get transferred to India, and as soon as visa #s are available we will get assigned one and called for the interview.
So we filed i824 - change request on exiting application, the request was pending all this while, we made several service requests in between. Basically it was a wasted effort, seems like USCIS officers didn't know what to do with the request.
Sept 2009: My wife's PD became current, we again prepared for filing 485 (took medical again etc).
Checked with my lawyer what needs to be done... her advice (this time both lawyers had the same advice), file 485 MAKE SURE they use the same Alien # that we got from my application.
Files on Sept 1st > Finger Printing 1st week Oct > my set of 485 files moved from Nebraska to Texas early November > 2nd set of 485's approved late November > 1st set of 485's denied based on 2nd set approval

Singing a country's national anthem and pledging allegiance to it are two different things. Scroll up and read my prev response.
Pride yourself on being a citizen of the world as you do, in normal course you have to be a citizen of at least one country to be able to receive a passport and travel the same world.... :)
As someone else pointed out, this thread is to appreciate the passion with which Pankaj sang the anthem. End of Story.

I did not feel like signing along for two reasons: we are not US citizen yet, and I consider myself citizen of the world and will always be. I do not aspire to become citizen of the United States of America.
Even when Americans sang their national anthem in a church, I felt not right. Churches are not supposed to be linked to states. There should be no country boundary within the Christian world.
There should be no country boundary within the world we want to build either.
By the way, if the United States go to war with your country of birth, who will you side with? Will the United States trust you?

Is it too much to ask Google to put a Diwali logo like it does for Hanukkah or Christmas .. at least if not in google.com but in google.co.in?
Also is it too much to expect American mainstream media to totally NOT ignore Diwali which has significance for the second largest population in the world and instead publish significantly less significant story of the balloon boy?
Is it too much to ask for to include Diwali in the spell check for this editor? (Not wailing or Gwalior ...)
It is this mentality of deliberately ignoring the feeling of majority of the world population that is getting the western civilization more and more isolated and retracted.
Well it doesn't really matter. And I am visiting India now and I can see that this country and China will definitely kick ass of Western civilization .. as it is already doing. The people here are hungry for more and in spite of seemingly unsurmountable problems it will succeed and once again India will be the "Sone Ke Chiriya".
With this thoughts and wishing peace .. happy and prosperous diwali to everyone.

call ur airport, I remember a friend got his I94 extended based on new I797 at the airport.
BTW- if u have an approved I797 and an expired I94, u are not out of status....when u travel next time out of country...keep current docs with u and when u reenter...the POE officer will give u i94 based on ur latest I797..
What I dont understand is when u entered US in may 06, with a I797 of 2010, why didnt the POE officer give u i94 until 2010?

1) Sep 16 2007 to Apr 2008 is > 6months so you cannot apply for 797 renewal to get a new i94 indirectly.

It is 6 months before status expiry date (I-94). This is not linked with visa stamp expiry date. You are mixing visa status dates with visa dates.

I'm in the same boat, FPd on 9/20 no LUD so far. Besides calling FBI FP phone number and checking with them if the results have been sent to USCIS you can't do anything other than waiting. FP has nothing to do with name check.
Some people got LUD after FP and some didn't ( like me). Please do a Google search "FP no LUD" and you will see various forums in , Immigrationportal, IV and murthy talking about the same and there is no black and white answer. Good news is some people even got green card without any update on the LUD.

I am in 7th year of H1b now..last time my h1b was renewed dates were until April 2008. I went to india in Dec 2006 and came back in Jan 2007. My passport was expiring on Sept 29th 2007 so Immigration officer dated my I-94 until sept 29th 2007 and told me same thing that you can go to any port of entery or international airport and meet USCIS officer and extend your I-94 with your new passport. I waited until last moment and around sept 24th I went to USCIS officer on airport as well as on Port of Entry (called Deffered Inspection site). Both places got answer you need to file extention online because we only correct mistakes and this is not a mistake but it was case of passport expiration. I called my lawyer, my hr, my company lawyer. Everyone told me I cant work after 29th sept as my i-94 is expiring. Thats same as your H1 expiring. SO either leave country and comeback with new stamping or file new h1b. I ended up filing new H1b as i had only couple of days left before my I-94 would have expired. I have filed I-485 and ead and my I-140 is pending. My pd is Dec 2003. As per my lawyer I want be out of status as mY I-485 is pending but I will loose eligibility to work as I wont have any work authorization once my I-94 expires and dont have EAD approved on my hand.
