As for the things you ask below - why should he do any of the things you ask for - its none of his business. Or actually, its none of our business to tell him how to conduct his business.
Don't want to get into a mudslinging fest here - just wanted to point out that sometimes posts like the original one are useful.
You can do hero worship of your lawyer whoever it is. I will not.
Ask him/her if he will do advocacy effort for you or sue USCIS since all his clients are struggling in the long wait and spending a lot of money on immigration consultations, fees etc.
Ask him if he contribute to IV instead?
Ask him to give you priority instead of your employer who gives him business every year.

renewal to get a new i94 indirectly.
2) Currently your status is H1 , if you use AP then ur status will becom Parolee and if you use EAD then "???"
I think of these solutions...

or
2) Talk to your employer ,find a temporary employer to switch your h1 and switch back to your current employer. ( do premium if necessary ).

Inform to SSN Office that you are leaving the country. It will make sure that nobody if steel your identity misuse your SSN. If some point in future if you return to US your credit history will not be bad.
Just send a letter for address change to US Imme office also get stamped in your passport about border crossing at US point.
I also had Canada PR but can not find a good job so cancelled it. I found that India is far better than Canada.

Please consult with an immigration attorney, to make sure your stay is legal. if your i-94 expired, unless you get the revised I-94 with the valid dates, your stay is illegal. If it is more than 180 days, then you are in deep trouble. Consult with an attorney and prepare to leave.....

look to see if you can reduce your monthly mortgage payment by means of "recasting". some mortagages offer this choice, some dont.
Say you are paying a note of 1500 per month, and you would like to pay 1400 per month, then assuming that you have put six months of expense aside in emergnecy funds, pay off your mortgage principal as much as you can. Next, call the lender to tell them that you want to recast the loan. Recasting means figuring out the payment as if your today's mortgage balance is what you would pay on for the rest of the period on your loan.
It may go down by say $50 dollars or sth. But thats the interest you would not be paying to the lender. Which is indeed the savings your will have. $600 / per year.

Most of the employers, HATE doing Percentage bases. Give any employer a choice, between doing working on 70/30 or 80/20 or with a Stright Salary... 99% would be willing to work on Straight Salary Basis. Because that's what is Required by the Law. Simple as that.
I do Agree that there are lot of employers, who don't pay on Bench. WE DO. Here is what has happened very recently with our employees.. Few of our Employees have QUIT because we refused to do % Basis & these are the guys who came 6 months ago on new H1b. I would understand the Senior Employees Who have been with us for say 2-3 years ask for % basis Pay.
Now We are in a situation where we have Agree on % Basis Pay as a Company Wide Policy & then offer is to all our employees.. But that puts us on odd with Department of Labor. Which Madates every H1B employee to be on staight Salary basis.
You tell us what are our Options.. Either we Fire/lose employees who want % Basis pay.. just because their peers are getting it (EVEN If it is ILLEGAL )
We Don't Charge a Penny for a H1b, We foot the Bill.. Just as an Example we LOST 32,000 This year, just in Lawyer fees for H1b's not selected in the lottery.. I Know & Fully Understand that its a Cost of doing Business..
Now, if we go on % Basis, our whole model changes... Because, There is Cost of Doing business, Managing Employees, Marketing, H1b, Greencard, Full Pay on Bench, & Last but not least Profit.
So if i have put employees on % Basis, that means We as company are making Hardly anything. Which means, we have to charge new h1bs, for at-least Lawyer fees.. What if it does not get selected, what do we do. Refund the money, Then whats a point of taking the money in the first place.
We WANT to pay on bench, because most people normally do find a project in 30-45 days, Provided they are Technically sound.
With Percentage Basis, We can't do that.. Since the Employee has chosen to work on Hourly.. No Work No Pay.
What should we do for Holidays .. Again No Work- No Pay..
We have done the Calculations.. Believe me.. There is Hardly any Difference Between % Pay & Straight Salary if you account the following at the end of year...
-- Medical & Dental Insurance.
-- Expense of Relocation, Moving your Apt, Car & Staying in Hotel for a week before you find a place to crash
-- No Bench Pay, No US Holiday Pay, No Sick Leave
-- No Pay for Vacation, Unless you don't Believe in Vacation.
-- No Green Card
-- No H1b Extension.. You would have to foot the bill at the end of your 3 year term on H1b.
When you account for the above.. you tell me..
We don't want our employees to take the Above risk.. believe me I have try to make these guys understand & have reasoned with them.. Provided with Financial Calculations..
What do (Some) of our employees see.... Just a Few Bucks more... Nothing else..
So I am going to let you guys Answer this Question...

Agreed. In addition, you don't have sword of VISA status hanging on you every morning when yuo wake up.
I can not convince my self about one would not get job forever. Few of my friends struggled for jobs for about six to ten months but then they actually got good jobs and that is even in industrail engineering area with indian experience.
Yes, thats what I am saying, too. Some of our friends perhaps had to look for a job longer, but some are even with the same comp for years and years, just reg 9-5 IT job, one guy is Sys admin, the other is programmer. I know it sounds unbelievable but no one complains about workload, having to sacrifice qaulity time with their familes, paying too much in taxes or car insuarance or similar. Moreover, they can afford to have vacation twice a year and they all have families, purchuased real estate and the likes.
In fact, in my home-country, coming to the US on H1 visa and then getting EB green card is literary unheard off. Very very few souls came via that route and not all succedded in getting their GC
The way things are right now is that my husband is married to his job, BECAUSE of VISA status sword, working overtime, sometime 24/7, not having time for his family and rather unsatsfied with the quality of life.
But then, that is nothing new, right? Everyone here is in the same boat.

if u can create a fairly intuitive JavaScript client update tool... will u ever need my sql or ne of that stuff? ( i mean i no its good to hav on ur resume etc but...)
im 17 and have my first "job" or request as its gonna b for free to giv me sum experience.. plus i work for them!! (part time as im in my penultimate year at school with no intentions of goin to uni)
i tell u theyr gonna be the coolest farm on the web!! lol
i thout itd b a good idea to at least get 1 example of wat i can do on the web b4 i start askin ne1 for money... just to let them no im serious uno?

Your profile does not sound enough for either EB1-OR (aka EB1-B aka EB1-2) or EB2-NIW. As pointed out before, if your employer is unwilling to "sponsor" you (i.e., not willing to sign a support letter), then you can go only with either EB1-EA or EB2-NIW. All other categories, including EB1-OR require sponsorship from the employer. In general, the lowest non-retrogressed preference level is the best bet. If you were born in Egypt, then that is EB2 (standard EB2 sponsored by your employer). For people who were born in India and (mainland) China, it is EB1.

Yes, I guess there's something FISHY. I really feel the PLOT is to rip of all the $$$ first by making dates current and bring in some crap legislation that'll throw everyone out. What a brilliant scam! Even Harshad Mehta will be impressed :-)
