    boreal, cool down. Just think what you will do if you are in that situation.
    At personal level ( micro level) these people are making right decisions. As long as you are not committing crime, nothing wrong with making decisions which are good for you. I will probably do the same thing if I am in that situation.
    The core problem with system was cheap money because of lax lending standard and low interest rates ( blame Greenspan) and affordable housing (like ACORN from Dems). These decisions are made by people in power and so called smart people. Individuals do have their contribution to the problem but the macro decisions provided them means to have things which they can not afford. The bubble had to burst sooner or later ....
    So right now, remember wealth is always relative. So since you haven't bought house, you don't have negative equity or declining value home.You haven't foreclosed so you can still get loan at decent rate and buy house at much cheaper price. All the people with money in the market are affected by recent downturn. So relatively speaking you are doing much better than a lot of other people ....
    BTW I am in the same situation as you are and waiting for good opportunity to buy house at cheap price. Do you see the positive side ? I hope you do .....

    People like you and boreal are doing much better because you decided that a 2 bed room house for rent is what you can afford because the prices shot up by guys like punjabi who wanted to make money and overbid on an house they cannot afford. Otherwise guys like you and many others would have bought house at a resonable price.
    Don't you see what is happening? They live a rich man's life buying house that they cannot afford and then they foreclose with banks taking the hit. The banks in turn gets money from Governement, which they tax on people like you and many others who are renting, so that the guys like pubjabi are entitled to big house and bailouts. This is sick. Where is my bail out money. I want my rent to be subsidized too. I think boreal 's anger is real.

    i dont think you will see a spike for jul/aug 2007 because thousands of apps got filed then, but this report is based off of the PD, not the date the 485 was applied.

    Dear Vamsi, SVK, NK, Shahuja, Abuddyz, and all eligible visa aspirants:

    I just got an email from the Chennai consulate, 29th day from the interview, stating the visa was stamped today:

    "Thank you for your e-mail.

    Our records show that your visa was issued today, January 31. You
    should be receiving your passport/visa soon.

    Moral of the story: "Never use a Consulate in India for visa re-validation again."

    Please learn from this story, and never again trust Consulates in India for extension purposes.

    How do you know that experience in Canada or Mexico will be any different from experience in India? It can be only better at a consulate that hasn't yet implemented PIMS, which I don't think there are any at this point. At least you are at home with family. I think the worst is to be stuck in Canada or Mexico for a month. I think the moral of the story is to use AP whenever possible.

    I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.

    They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

    it asks last five year employment history , i have not worked in USA for the past 3 year but i have worked abroad before these 3 years.. should i write it in the column or i should write NONE as i have not worked here in USA .... i am not the primary applicant ... my husband is primary applicant

    If her lawyer is quick to respond then you can keep everything ready including medicals and anytime date is retrogressed should apply immediately or the second option is apply for EAD and AP and I-485 case and go tense free and use EAD if you want to change jobs and don't worry about EB2 and EB3.
    If the removal of AC21 succeeds in CIR, then forget about switching jobs.

    Like others have pointed out, it looks like that the numbers are being allocated in a different way from before. Does any one know of any article or discussion by a real attorney or some expert on what is going on?

    USCIS may be using divide and silence tactics. One can already see the impact of EB2 being as good as current. They probably liked what they saw and are setting up to move back EB3 much more. At this rate EB3 will crawl to death. People will try to jump into EB2 and realignments/adjustments automatically will take place.All good for USCIS.

    But, going back to my original question, what are the legal experts saying? Can any legal entity or any type of action force USCIS to explain what the heck is going on?

    Hmmm.. Level playing field. You mean the field where you set the rules? UAW did that in GM - you know?

    If there is someone who can do my job cheaper or better or more efficiently - by all means it should go to him. I need to then find something where I am good at. Thats what competition is! Of course - this "efficiency" can not come by illegal behavior. Illegal behavior (like the L1 fraud) has other hidden problems.

    So on your question about "l1 fraud": by all means I am for reporting it. However, there is another overriding concern for ALL OF US - how will the economy behave? I dont want to worsen things by "reporting fraud" at a mass scale right now and create trouble for companies that are already suffering. I will do that when that will be beneficial for the US Economy (translation - "all of us - even citizens").

    I am not for tolerating or condoning illegal behavior - however, I am all for moderating my responses and prioritizing the fights. I am also for not behaving like the UAW members.

    Guys:
    Here is my scenario :

    We have a 3 year extension( H1-B for myself) and (H4 for my wife) based on an approved I-140 valid till Feb'2010.

    I am going to apply for I-485(both) next month and EAD for my wife.

    My questions are :

    A) Do I need to apply for EAD for myself ? If yes, what are the benefits ? Does it help to have an EAD, if I decide to change jobs using AC21 after 180 days of filing I-485 ? Or any other benefit ?

    B) Do I need to apply for AP for both me and my wife ? Can't we travel and then get Visa stamped for 3 years (till 2010) based on the I-797 that I have ?
    Do we have to use AP only if we want to travel, once we have filed I-485 ?

    I just wrote a letter detailing my frustrations and attached with it the documents. I don't think the call was anything big deal.....it was more a courtesy call an image improving call...we were not told anything that we didn't know already.....USCIS always raised more questions than answering them.......

    I got the RFE at last. I invoked AC21. The RFE for me is asking for 2 evidences

    01. Why in Form I-693 medical examiner submitted x-ray but no skin test (we did it because we had the TB vaccination in childhood and skin test would come positive and we had to take x-ray anyway) ---Not an Issue, we can answer that

    02. Submit current dated EVL for your new employer. No issue. we can answer that

    For my wife also asking for 2 evidences:

    01. About the same medical issue.
    02. Provide her non-immigrant status between Feb 2003 to Jan 2004.

    I don't know what do. Looks like we are doomed. My wife came here with H4 in 2000, was provided I-94 from the airport for 3 years (till Jan 2003), we didn't know then that we have to file a I-539 extension for H4 extension (even couple of my friends had the same idea). We knew that as long as I am on H1, she would maintain H4. I came to know in Jan 2004 and then we applied for I-539. I know this is stupid but that what happened. Anybody has any experience please reply..please please. We are really sleepless this time.


    I personally know a friend of mine who did the same mistake. He was not aware that he will also have to file for his wife when he did an h1 ext few years back. Lawyer was also not aware that he was married at that time. His 485 is still pending in EB-3, so no idea what would be the outcome.

    A# is the alien number that is given to the applicant during the GC process. It is either given at 140 approval or at 485. If you have a A# in your 140 approval then you can use that # in all your 485 forms.
    To answer pranju's question, yes its only for primary applicant. You can leave that field as blank for your spouse.

    I have a copy of my approved I-140, and the only number I see on it is Receipt Number at the top left side of the notice. It reads like LIN-xx-xxx-xxxxx.

    Is this the A# number you are referring to?

    For those of us who have become "current" with the latest VB movements, I have some discouraging news for you: at least for the Nebraska Processing Center, the current processing date for an employment-based I-485 has retrogressed from September to August,2006. Only a small step backwards but a step backwards all the same.

    Congratulations on getting approved. My wife traveleved to India in a similar situation. She left 2 days after the GC approval email. She returned yesterday on her H1B. I think the systems at the POE take time to reflect the new status. She was planning to inform the IO in case he/she asks about the GC approval - but they did not ask anything. Before she left, she spoke to a second level IO who said it was OK to travel and just to explain to the IO at POE in case it comes up. D-155 stamp is not done at POE.
    Your wife can either use AP or H4.

    EB-2 Movement in May
    April 5

    Will EB-2 India will advance "substantially" in May?

    There are 18,000 persons with EB-2 priority dates in 2006 who are waiting for green cards, 13,000 of them from India.

    Given the 7% country quota, we expect the India EB-2 to move forward in May between 2 weeks and 2 months.


    * This is seems to be completely different from what they claimed "substantial" before.....:confused:

    And their news page has also changed to reflect this "modest" movement (previously it stated - "the movement will not be weeks or months but could be years")

    On both extremes, it's nothing but just an attempt to generate traffic to the website I guess.

    Interesting that he claims - the modest movement will be because of the 7% country cap. In my understanding, it does not apply when spiilover happens (plz correct me if I am wrong)

    Along with free india callling you also have the basic feature of calling unlimited in US for 24.99. Which looks pretty good to me. I already have a vonage service for 24.99 and it was a free upgrade to this new plan(after i called the customer service rep) and still i am paying the same 24.99 which is good.

    Thanks for the information about your Vonage plan but the question was if it is only limited to 5000 minutes. Lot's of people like me use Trueroots/ Reliance with no home line so I was thinking aloud if it is worth signing up for the service.

    I have a quick question, Some of you had an older EB3 pd active, filed 485 and then either ported or have used a newer EB2 and gotten approved and Greened.

    Now, knowing USCIS uses outdated software, the question is are these people that are greened, taken out from the so called "queque" for EB3?. And then hopefully the line gets shorter for EB3s?.

    yes, i am from one of those queues, i ported my EB3 to EB2 , so 2 less entries there, i know of several folks that did as well.

    my CPO was based on A# from that queue
