Guys we are still in the game, and we have to be untill the bill (even in the current form) passes in the house. If you remember S.1932 was trashed by the house, so thing will get more hectic for us and certainly for each of you once the bill get passed in the senate. We have to keep all the sections related to EB hitech workers afloat.

The IV is about issues/problems of employment based immigrants, and the goal is to get support as much as possible from every corner in this country to further the cause. Everyone who supports this cause fit in to some category (within legal limits - pro, anti, this group, that lobby, this ethincity, that nationality, etc.), and that does not mean we are promoting something or have preferences for a group. In my opinion any support (with in the legal framework) to the cause of IV from any corner in this country is welcome and should be appreciated.

Let me ask you this : why did they even grant me the h1 approval i797 form? Even when they know that my 485 is pending?
Also at the Consulate they gave me a stamp, despite knowing that my GC process is ON.
All that tells me that USCIS and DOS allows this dual intent.
Any more thoughts from the Gurus?

Based on what you believe that "BC has a much higher standard of living than Boston?". I hope that is not one of those silly annual surveys in which they interview low income and beggars on the streets and rate mainly based on health care and welfare for them.
Regarding raising kids, if you believe that doing that around prostitutes, lesbians and drugs is a good thing, so go ahead and live in BC.

The other reason is that you could always come to the USA from Canada later but if you lose the Canadian PR now and don't manage to get a green card in the US, you lose everything.

Help!!
Is any company filing new PERM applications in this economy? I was told that my current company (a really big one at that) is holding off PERMs indefinitely because we had some layoffs- indefinitely!
My H1 runs out in Oct 2010, and I heard that I have only till end of Nov 2009 (including what I found out is called recapture time) to file.
Now, I found out that my company have do newspaper/online ads for positions to demonstate that they tested the labor market etc etc (all stuff that I heard from the attorney), and I got the impression that she has no idea when they are going to do this and start filing again, and I got something like a best of luck look from her. I am freaked out now.
Any of you out there know if any companies are still filing PERMs? I am on a EB-2 in Software.
Also, if I join a new company, can I file a PERM immediately? Or is it just best of luck to me?

My plan is making the following
Movie - A full length feature with characters that represent our life (includes H1 to GC process) in US with humor
Documentary - A professional documentary on our issues like H1 quota problems, GC backlog processing etc.
As most Americans are not aware of employment based GC, I think a professional documentary makes more sense than a full length movie. (I wonder why Michael Moore didn't attempt this before :rolleyes:)

I appreciate all your efforts and have made my own contributions to support what IV does. Lately due to the political standstill in the House, we have not seen much movement on the immigration issue. At the same time it is important to have some actions illustrated in the open forum to attract the attention of new members and existing members who continue to visit this website. I am of the opinion that unless the 'interest level' of people is maintained in coming to this website, understanding the action items and following them, people will lose interest in visiting this website.

If your cousin's company is based in India and has no US subsidary or legal relation with any US-based company, the money is TAX FREE. If they open a US account, they would have legal relation to the US system and therefore have to pay income tax on it.
If they use your account, you will get a 1099 from their client and therefore will show as your earnings and tax will be based on the bracket you fall in (after you add the 1099 earnings). If you are on a work visa (like H1B), this is illegal except for interest earned (I-1099) or stocks/dividents. Other 1099s might affect your immigration process.
Client can use Remit2India, PayPal (charges fees), Creditcards (charges fees) OR just use their company bank (usually free if paid in US dollars).
Thing to keep in mind is: fees, foreign transaction fees, conversion fees are all different from US taxes.

Isn't it a relief? if the officer calls you for interview, checks your documents and says approved but no GC till PD current? I can live happily with it for couple of years atleast without thinking of GC. The feeling of getting GC in future 100% is almost equal to having GC today. You can change jobs on AC21 without fear and use EAD and AP full force and forget about renewing H1b's

I think the contributions are only from those who visit this forum regularly on a day to day basis. I think there are just many people who might have just registered to get some updates but don't necessarily visit this or any other forum regularly.
A lot of people I know get their updates from the web site of one of the law firms, but don't necessarily participate in this or any other forum. Otherwise, they just carry on with their lives hoping some law will pass some day.
Some of those to whom I have talked about contributing to IV have politely said they will take a look at it. Otherwise, I feel they have just been institutionalized in their current setup and lives. I don't think the message has really reached them that there is a need to participate and contribute in a organization like IV and try and make a difference.

a person has contributed. You are not forced to contribute, if you think by contributing it might help all of us, please do so.

I did a blunder by not renewing my passport and travelled to India in August 2007, while returning to US , CBP officer in Chicago issued my I94 only till the expiration of Passport , which is March 2008 . My VISA was valid till Jan 2010
I tried to argue but no use his quote "You can not stay in this country with expired passport" as if there is definitive rule
Irony is I travelled to Canada in July 2007 and at that time my I94 was issued till Jan 2010 . It depends on the officer .
Moral of the Stroy "Renew your passports as soon as you can"
I went to Chicago airport after renewing my passport to renew my I94 , but the officer bluntly denied and asked me to visit USCIS local office . Again just few months back my friend was able to change his I94 in the same airport , looks like I m not that lucky
I contacted my Lawyer on the situation and he suggested either to apply for I94 extension with CIS or travel to Canada . Applying with CIS with 300$ fee doesnt make much sense to me so I decided to fly to Canada and got my new I94 -- Yahoooo atlast valid till Jan 2010
Again in the Tornoto airport officer offered me to keep the same I94 as I did not leave US for more than 30 days , After few scary moments I requested that I needed the new I94 and explained my situation and got it.
